조선총독부는 조선총독부 사법관 충원을 위해 1910년 10월 제정된 제령 제6호에 의해 일본의 재판소구성법상의 사법관 자격을 갖춘 자를 조선총독부 판검사로 임용할 수 있도록 하는 한편, 이러한 자격이 없는 자를 조선총독부 사법관으로 특별임용하기 위한 제도로서 두 개의 제령을 시행하였다. 1910년 10월 제령 제7호(조선인인 조선총독부재판소 직원의 임용에 관한 건)에 따르면, 제국대학, 관립학교 또는 조선총독이 지정한 학교에서 3년 이상 법률학과를 졸업한 조선인은 문관고등시험위원의 전형을 거쳐 조선총독부 판검사로 특별임용할 수 있고, 1920년 제령 제11호(조선총독부판사의 특별임용에 관한 건)에 따르면, 지방법원 지청의 판사로 보할 자에 한하여 당분간 5년 이상 재판소서기 등 판임관 이상의 관에 재직하며 사법사무에 종사한 자를 고시를 거쳐 판서로 특별임용할 수 있다. 조선총독부의 판검사 특별임용제도에 관한 종래의 문헌 및 최근 연구에서는 1910년 제령 제7호는 조선인에게만 시행되는 특별임용제도이고 1920년 제령 제11호는 조선인과 일본인에 공통으로 적용되는 특별임용제도라고 이해하고, 1920년 제령 제11호에 따라 재판소서기로 재직중인 조선인과 일본인이 총독부 판검사로 특별임용되었다 설명하고 있다. 그러나 1920년 제령 11호를 제정·시행하는 과정에서 작성된 문서와 실제 특별임용사례를 자세히 살펴보면, 특별임용제도에 관한 종래의 이해와 설명이 매우 부정확하다는 것이 드러난다. 이 글에서는 1920년 제령 제11호는 ‘사실상’ 일본인만을 위한 특별임용제도를 마련한 것이라는 점, 바꿔 말하면, 조선총독부는 1910년 제령 제7호와 1920년 제령 제11호를 통해 조선인과 일본인을 구분하여 별개의 특별임용제도를 설정하고 운용하였음을 밝혔다, 아울러 민족 구분에 따른 특별임용제도의 운영 실태를 특별임용자의 학력, 임용 전 경력, 임용 후 보직과 승진 등 여러 측면에서 살펴보았다.
For recruiting judicial officers of the colonial courts in Korea, the Governor General’s ordinance No. 6 promulgated in 1910 by the Japanese Government-General of Korea allowed to appoint qualified judges, prosecutors, or judicial apprentices under the Japanese Court Organization Act, while implementing two ordinances to introduce a special employment system to appoint unqualified persons as judicial officers. According to the ordinance No. 7 of 1910, A Korean who had graduated from the department of law of Imperial University, government schools, or schools designated by the Governor-General could be specially appointed as judges or prosecutors. According to the ordinance No. 11 of 1920, regarding the special appointment of judges of the Government-General’s Court, a person who had been engaged in judicial affairs as a court clerk for more than five years could be specially appointed as a judge of the district court branch. In previous literatures and recent studies on the special appointment system of judicial officers of the colonial court, it was understood that the ordinance No. 7 of 1910 was only applied to Koreans and in accordance with the ordinance No. 11 of 1920, Koreans and Japanese serving as a court clerk were specially appointed as judges. However, the documents prepared in the process of enacting and enforcing the ordinance No. 11 of 1920 and actual cases of special appointments, it is revealed that the understanding and explanation of the special appointment system so far are inaccurate and wrong. In this article, it is explained that the ordinance No. 11 of 1920 established the special appointment system only for Japanese, in other words, through the ordinance No. 7 of 1910 and the ordinance No. 11 of 1920, the Government-General of Korea established and operated ethnically differentiated special appointment system of judicial officers. In addition, this article examined the aspects of the operation of the special appointment system according to ethnic classification through data on academic background, pre-appointment experience, and post-appointment position and promotion.
