토지의 저당권과 함께 설정된 담보지상권은 토지의 저당권이 실행될 때까지 제3자가 용익권을 취득하거나 목적 토지의 담보가치를 하락시키는 건물축조 등의 침해행위를 방지함으로써 저당부동산의 담보가치를 확보하려고 한다. 이는 저당물 토지의 담보가치 유지를 위해 설정되는 담보지상권은 용익권에 속하는 지상권이 담보 목적으로 전용된 것이라고 할 수 있다. 토지 저당권 설정과 더불어 담보지상권을 설정하는 관행이 형성되었고, 이러한 형태의 지상권의 효력을 인정하는 것으로 법적 확신이 형성되었으므로 담보지상권은 관습법으로 창설된 물권으로서 유효하다고 할 수 있다. 그리고 담보지상권은 건물, 공작물 등을 소유할 목적으로 설정하는 것이 아니므로 지상권에 관한 민법 제279조 규정에 반하여 무효라고 할 수도 있다. 그러나 담보지상권은 민법 제279조가 아닌 관습법으로 창설된 물권의 일종으로 이해한다면, 건물, 공작물 등을 소유할 목적이 없는 담보지상권을 무효라고 단정할 수는 없다고 본다.
제3자가 지상권설정자에게 해당 토지를 사용·수익할 수 있는 채권적 권리를 가지고 있다고 하더라도 이러한 사정만으로 지상권자에게 대항할 수는 없다. 그러나 담보지상권의 경우, 담보지상권 설정자가 그 토지의 담보가치를 하락시키지 않는 한 임대차, 사용대차 등으로 제3자에게 점유․사용할 수 있는 권리를 부여하는 것은 적법한 담보지상권 설정자의 점유․사용의 방법에 해당하므로, 이때 제3자의 채권적 권리는 담보지상권자에게 대항할 수 있다고 볼 수 있다. 다만, 점유권원을 설정받은 제3자의 점유가 저당권의 실현을 방해하기 위한 것이고, 그 점유로 인하여 저당권자의 교환가치 실현 또는 우선변제청구권의 행사와 같은 저당권의 실현을 방해하는 특별한 사정이 있는 경우에는 저당권의 침해로 인정될 수 있다. 한편 담보지상권자에게는 일반적으로 임료 상당 이익이나 기타 소득이 발생할 여지가 없으므로, 손해도 발생하지 않는다. 그래서 담보지상권자는 특별한 사정이 없으면 토지의 소유자 또는 제3자의 저당물 토지의 점유․사용으로 인한 손해배상이나 부당이득반환을 청구할 수 없다.
The Civil Law Article 279 (Contents of Superficies) A superficiary is entitled to use the land of another person for the purpose of owning buildings, other structures or trees thereon. Therefore, the superficies belong to usufruct, and the superficiary can occupy and use the land. When the registration of superficies has been completed, the right to use and benefit from the land belongs to the holder of the superficies, and the land owner who has established the superficies cannot use or profit from the land as long as the superficies remain.
The collateral superficies established together with the mortgage of the land seeks to secure the collateral value of the mortgaged real estate by preventing a third party from acquiring usufruct or infringing acts such as constructing buildings that lower the collateral value of the land until the mortgage of the land is exercised. This can be said that the security superficies established to maintain the collateral value of the mortgaged land are diverted superficies belonging to usufruct for the purpose of collateral. With the establishment of land mortgage, the practice of establishing security superficies was formed, and legal certainty was formed by acknowledging the effect of this type of superficies. Therefore, collateral superficies can be said to be valid as real rights created by customary law. In addition, since the superficies as security are not established for the purpose of owning buildings, structures, etc., they can be said to be invalid contrary to the provisions of Article 279 of the Civil Act on superficies. However, if the security superficies are understood as a kind of real right created by customary law rather than Article 279 of the Civil Act, it is not possible to conclude that the superficies secured by no purpose of owning buildings, structures, etc. are invalid.
There is generally no room for rent-equivalent interest or other income to be generated by the superficies, so no loss is incurred. Therefore, the security superficies cannot claim compensation for damages or return of unjust enrichment due to the possession and use of the land by the owner of the land or by a third party, unless there are special circumstances.
