2018년 12월 한국서부발전 태안발전본부에서 발생한 ‘김용균’ 노동자의 사망 사건에 대하여 최근 제2심 판결이 선고되었다. 이에 따르면 원청인 한국서부발전의 대표이사와 태안발전본부장은 모두 무죄이며 하청인 한국발전기술의 대표이사도 산안법 위반 행위에 대해서는 무죄이고 업무상 과실치사죄만이 인정되었다. 산안법 위반과 업무상 과실치사가 모두 유죄로 인정된 사람은 한국발전기술의 태안사업소장 1명뿐이고, 그 밖에 한국서부발전 태안발전본부의 기술지원처장과 연소기술부장, 연소기술부 차장, 석탄설비부장, 석탄설비부 차장, 그리고 한국발전기술 태안사업소의 운영실장, 연료운영팀장, 안전관리차장 등 중하위급 관리자들에게는 업무상 과실치사죄가 인정되었다.
제1심과 제2심의 차이는 산안법에 규정된 의무 위반 행위 가운데 일부에 대한 인정 여부 그리고 산안법 위반과 업무상 과실치사죄에 해당하는 사람의 범위에 있다. 이 가운데 전자의 문제는 사실 판단과 관련되는 것이므로 이 글에서는 분석하지 않는다. 후자의 문제는 산안법상 안전조치 의무의 주체 그리고 업무상 과실치사죄가 전제하는 주의의무의 범위와 관련이 있다. 특히 이 사건과 관련하여 이것은 기업의 대표이사와 같은 최고위 관리자가 위험한 작업을 하는 노동자에 대해 갖는 보호의무 또는 안전보건 문제에 대한 관리‧감독의무가 어디까지 인정되어야 하는가 하는 문제가 된다. 따라서 이를 산안법과 형법의 경우로 나누어 살펴본다.
이외에도 양형의 문제가 있다. 2심에서 선고된 자유형의 최장기간은 한국발전기술 태안사업소장에 대한 1년 2개월이고 그 밖의 다른 피고인들에 대해서는 각각 금고 1년, 금고 10개월, 금고 6개월에 지나지 않았으며, 법인인 한국서부발전과 한국발전기술에 대해서도 각각 벌금 700만원과 1200만원이 선고되었을 뿐이다. 최소한의 예방 효과마저 의심되는 이러한 낮은 수준의 형벌은 그동안 중대재해에 대해 우리 사법기관이 가져온 인식이 여전히 그대로임을 잘 보여준다.
하지만 이 사건을 계기로 기업 경영책임자의 안전보건확보의무를 규정한 ‘중대재해 처벌 등에 관한 법률’이 제정되었다. 이것은 노동자에 대한 사업주의 보호의무에 대한 우리사회의 규범적 합의가 달라졌다는 것을 뜻하므로, 비록 이 법률은 이 사건의 발생 이후에 제정된 것이지만, 그 취지가 판결에 다소라도 반영되었으면 하는 아쉬움을 남긴다.
Recently, the second trial ruling was sentenced on the death of "Kim Yong-kyun" worker at the Taean Power Headquarters of Korea Western Power in December 2018. According to the verdict, both the CEO of the main contractor, Korea Western Power Co. and the head of the Taean Power Headquarters were innocent, and the CEO of the subcontractor, Korea Development Technology Co. was also acquitted of violations of the Industrial Safety Act but just guilty of death by occupational negligence. Only one person, the Manager of Taean Office of Korea Development Technology Co. was found guilty of both industrial safety violations and occupational negligence. Intermediate and lower-level managers such as the technical support manager, combustion technology manager, coal facility manager, and safety manager were admitted just guilty of death by occupational negligence.
The difference between the first and second trials is whether some of the violations of obligations stipulated in the Industrial Safety Act are recognized, and the scope of those who fall under the violation of the Industrial Safety Act and occupational negligence. Among them, the former problem is related to factual judgment, so it is not analyzed in this article.
The latter problem is related to the subject of the obligation to take safety measures under the Industrial Safety Act and the scope of the duty of care presupposed by the crime of occupational negligence. In particular, in relation to this case, this becomes a question of how far the duty of protection or management and supervision of the highest manager, such as the CEO of a company, for worker’s safety and health issues has to be admitted. Therefore, it is examined in view of the Industrial Safety Act at first and then the Criminal Law.
In addition, there is a problem of sentencing. The longest free sentence sentenced in the second trial was only 1 year and 2 months for the Taean office of Korea Development Technology Co., and the other defendants were just 1 year, 10 months, and 6 months, respectively. This considerably low level of punishment, which is suspected of even the minimum preventive effect, shows that the perception that our judicial institution has taken about serious accidents of workers remains the same as before.
However, in the wake of this case, the Serious Accidents Punishment Act, which stipulates the obligation of corporate executive officers to secure worker’s safety and health, was enacted. This means that the normative agreement of our society on the employer’s duty to protect workers has changed, so although this law was enacted after the occurrence of this case, it leaves a regret that the purpose of the law would be somewhat reflected in the judgment.
