제15차 생물다양성협약 당사국총회에서 ‘자연과 조화로운 삶’이라는 비전을 2050년까지 달성하기 위한 ‘쿤밍-몬트리올 글로벌 생물다양성 프레임워크(GBF)’ 전략계획이 채택되었다. 지난 10년의 생물다양성협약 전략목표가 성공하지 못하였기에, 포스트-2020 글로벌 생물다양성 전략목표와 이행수단, 당사국의 주요 의무들은 무엇인지 알아보는 것은 의미가 있다. 무엇보다 주목할 것은, 그동안 당사국 간 많은 의견 대립이 이어져 온 디지털 염기서열 정보(DSI)가 이익공유 대상이라고 GBF 문서로 명시된 것이다. 전통적으로 나고야의정서의 물적인 적용대상은 유전자원 및 토착민이 보유한 유전자원과 관련된 전통지식인데, 유전자원에 관한 디지털 염기서열 정보의 이익공유가 추가된 것이다. 이에 본고에서는 쿤밍-몬트리올 GBF의 주요 내용들을 살펴보고 디지털 염기서열 정보의 논의 경과와 함께 결정문의 분석을 토대로, 디지털 염기서열 정보의 이익공유에 대한 우리 정부와 산업계를 비롯한 적절한 대응방안을 다음과 같이 모색하였다. 첫째, 디지털 염기서열 정보의 다자간 이익공유 체제 도입에 대한 철저한 검토가 필요하다. 둘째, 공공데이터베이스의 적극 활용과 공공데이터베이스의 이용료 부과나 이익공유와 같은 제한에는 반대의 목소리를 높여야 한다. 셋째, 디지털 염기서열 정보가 다자 이익체제의 대상이 된다고 하더라도, 이용자들은 제공국의 유전자원 접근 및 이익공유 관련 법률을 반드시 살펴보아야 한다. 마지막으로, 우리나라 이용자들은 정부의 지원 시책을 적극 활용하여 디지털 염기서열 정보 접근 및 이용에 필요한 사항들을 적극적으로 요구하여야 한다.
At the 15th Conference of the Parties to the Convention on Biological Diversity, the strategic plan for the ‘Kunming-Montreal Global Biodiversity Framework (GBF)’ was adopted with the goal of achieving the vision of ‘living in harmony with nature’ by 2050. Of particular note is the inclusion in the GBF document that Digital Sequence Information (DSI), which has been a subject of significant disagreement among countries, is now designated as a subject of benefit-sharing. Therefore, in this paper, I examine the key elements of the Kunming-Montreal GBF and, based on an analysis of the discussions and decisions surrounding DSI, I explore potential strategies for addressing benefit-sharing of DSI. This exploration involves our government, as well as the industry, in light of the evolving discussions and outcomes related to the GBF. Firstly, a thorough examination of the introduction of a global multilateral benefit-sharing mechanism for DSI is necessary. Secondly, there should be an amplified voice against limitations such as imposing fees for the use of public databases or imposing restrictions on benefit-sharing while actively utilizing public databases. Thirdly, even if DSI becomes part of the multilateral benefit-sharing system, users must carefully review the laws concerning access to genetic resources and benefit-sharing in provider countries. Lastly, users in our country should actively demand the necessary provisions for accessing and utilizing DSI by making full use of the government's support policies.
