Canada differs from Korea with respect to the history of law, legal regime, and judicial system, as it has common law tradition(but Quebec). Still, Canada and Korea have a question, and some of the answer to it, in common : how to deal with the law declared unconstitutional? Canadian jurisprudence on the forms and effects of court decisions declaring a law unconstitutional has been shaped and developed through the rulings of the Supreme Court of Canada on the basis of section 52(1) and 24(1) of the Constitution Act, 1982. The Court has conceived unique solutions to the question(including suspension of declaration of invalidity, its retroactive or prospective effect, individual remedy), developing abundant constitutional discourses based on the 3 pillars of constitutional principles; constitutionalism, rule of law, and the separation of powers, each of which partly supplements or partly contradicts with others. The Court provides possible full explanation of the general theories and the case applications in the ruling.
The Court has developed several variant forms of decisions besides ‘declaration of invalidity’, enshrined explicitly in section 52(1). They include reading down, reading in, severance and the suspension of declaration of invalidity. The last one was, as was in Korea and in Germany, coined to cope with the problems of legal vacuum arising from immediate and retroactive effect of invalidity of laws declared unconstitutional. Here, the law keeps its validity during the suspension period, and the legislature has chance to enact new regime in compliance to the ruling. The suspension of declaration of invalidity in Canada corresponds to the unconformity decision in Korea(rendered by the Constitutional Court of Korea).
Declaration of invalidity takes effect when suspension period expires. The effect is presumptively retroactive, though the court can recognize purely prospective effect when it deems a retroactive application of the declaration could frustrate the very purpose of the suspension. In case of prospective application, the law declared unconstitutional becomes invalid only from the expiration of suspension period to the future. Criminal law also can be suspended and combined with purely prospective effect. This enables to keep punishing those crimes that do not furnish any ground of the unconstitutionality of the law.
To prevent the possible infringement of rights of the claimants due to the continued validity of the unconstitutional law during the suspension period, the Court generally grants individual remedy on the ground of section 24(1). That is the ‘exemption of suspension.’ Suspension combined by the individual exemption enables to reconcile the need for general application of law with the individually tailored rights guarantee. This should be highly esteemed.
