모든 국민은 재판을 통해 최종적인 판단을 받을 권리가 있다. 그런데 행정 관계 법령해석의 경우에는 최종적인 판단을 사법부에 유보하면서도, 사전에 법제처의 유권해석을 받을 수 있다. 이 논문에서는 재판제도와의 비교를 중심으로, 사법부의 판단을 받기 전에 그보다 간명하게 분쟁을 해결하도록 하는 법제처 법령해석제도의 단계별 쟁점을 연구하기로 한다.
Ⅲ에서 크게 접수단계, 검토 및 심의단계, 회신단계의 세 단계로 구분하여 법제처 법령해석제도의 단계별 쟁점을 검토하였는바, 접수단계의 주요 쟁점은 안건 적격에 있고, 안건 적격을 파악하기 위해서는 법령해석의 목적이 구체적 사건을 대상으로 하는 구체적 규범 통제가 아닌 추상적 규범 통제라는 점에 특히 주목해야 하는바, 관련된 반려 사유인 해석 대상 법령 및 법령해석요청 주체 등, 정립된 판례나 법령해석기관의 법령해석이 있는 경우, 구체적 사실인정에 관한 사항인 경우, 이미 행해진 처분이나 행위의 위법․부당 여부에 관한 사항인 경우, 법령해석요청 비용, 법령해석요청서의 기재 사항을 중심으로 접수단계의 쟁점을 검토하였다.
법제처 법령해석제도 검토 및 심의단계의 내용적 특징으로는 현행법령의 적법성을 전제하는 행정해석의 한계를 들었고, 절차적 특징으로는 재판과 달리 법령해석기관이 주도적으로 질의요지를 구성해야 한다는 점, 법령 소관 중앙행정기관의 장의 당초 회신내용과 다른 해석을 하는 경우 가중 의결요건을 적용한다는 점, 판례의 구별과 같이 법령해석례의 구별로써 법령해석례의 변경을 갈음하게 된다는 점 등을 살펴보았다.
법제처 법령해석제도의 회신단계에서는 법령해석례의 형식을 판결문과 비교하고, 행정부의 최종적인 유권해석으로서 법제처의 정부유권해석이 관계 행정기관에 대해 사실상의 구속력을 가진다고 분석하였다. 법령해석례의 범위를 판례의 범위와 비교 검토하였고, 법령해석례의 공개와 관련된 쟁점을 살펴보았으며, 법원과 별개로 법제처에서도 자체적으로 법령 정비 권고사항 등을 통해 법령에 대한 추상적인 규범 통제를 하고 있다는 점을 확인하였다.
Ⅳ에서는 법령해석제도의 발전 방향을 단계별 쟁점별로 분석하였는데, 법령해석 접수단계에서는 1차적 법령해석의 DB화와 AI를 활용한 검색의 용이화를, 검토 및 심의단계에서는 법령해석정책협의회의 개최, 가중 의결요건의 폐지 및 법령해석국의 조직 확대를, 회신단계에서는 질의 배경에 대한 간단한 설명의 부기와 주론의 표시를, 법령해석제도의 사후관리로서 정부유권해석의 실효성 제고를 제시하였다.
Every citizen has the right to a final judgment through a trial. However, in the case of interpretation of administrative regulations, the final judgment is reserved for the judiciary, but it is possible to receive a preliminary interpretation from the Ministry of Government Legislation. In this paper, we will study the issues of the stages of the statutory interpretation system, which allows for simpler dispute resolution before receiving judicial judgment, centering on a comparison with the trial system.
The main issue in the reception stage is case eligibility, and in order to determine case eligibility, it is important to note that the purpose of statutory interpretation is to control abstract norms, not to control concrete norms targeting specific cases. I reviewed the issues at the intake stage, focusing on the relevant reasons for rejection, such as the statute to be interpreted and the subject of the request, if there are established precedents or statutory interpretations by statutory interpretation organizations, if it is a matter of recognizing specific facts, if it is a matter of illegality or impropriety of a disposition or act already performed, the cost of the request, and the contents of the request for statutory interpretation.
The content features of the review and deliberation stage of the statutory interpretation system include the limitations of administrative interpretation, which presupposes the legality of current laws and regulations, and the procedural features include the requirement for the statutory interpretation agency to take the initiative to formulate the questionnaire, unlike a trial; the application of an aggravated voting requirement in the case of a different interpretation from the original reply of the head of the central administrative agency in charge of the statute; and the distinction between statutory interpretation cases and changes in statutory interpretation cases, such as the distinction between precedents.
In the reply stage of the statutory interpretation system, I compared the format of the statutory interpretation with the judgment, and analyzed that the statutory interpretation is de facto binding on the relevant administrative agencies as the final voting interpretation of the executive branch. The scope of statutory interpretation cases was compared to the scope of precedents, issues related to the disclosure of statutory interpretation cases were examined in this review, and it was confirmed that, apart from the courts, the Ministry of Government Legislation has its own abstract normative control over statutes through recommendations for statutory improvement.
Finally, I analyzed the development direction of the statutory interpretation system by stage and issue, including the DBization of primary statutory interpretations and the ease of searching using AI in the statutory interpretation reception stage; the holding of the Statutory Interpretation Policy Council, the abolition of the weighted voting requirement, and the expansion of the organization of the Statutory Interpretation Bureau in the review and deliberation stage; the bookkeeping of a brief explanation of the background of the question and the display of the main argument in the reply stage; and the improvement of the effectiveness of government authoritative interpretation as a follow-up management of the statutory interpretation system.
