벤담과 밀은 공리주의를 처음 시작할 때부터 처음부터 명백하게 공리성의 원칙, 효용원리, 최대행복원리를 도덕과 입법에 관한 공리주의의 원리이자 정의의 원리로 제안하고 있다. 롤스는 공리주의가 시민의 평등한 자유권과 개인성을 침해한다는 이유로 공리주의를 비판하고, 공리주의를 대체하는 정의론을 고안하고자 한다. 그래서 이 논문은 밀의 공리주의 정의론을 정립해나가면서 롤스의 공리주의에 대한 비판도 함께 살펴볼 것이다.
이 논문은 첫째, 공리주의의 효용원리 또는 최대행복원리에 대한 일상적인 오해를 바로잡고자 한다. 공리주의의 효용은 어떤 행위나 사회제도의 효율, 효과, 이익, 결과가 아니라 개인과 사회의 쾌락과 고통이자 행복이다. 개인이 사적인 이익을 추구하면서 사회적인 이익을 함께 실현한다는 것이 공리주의의 효용원리 또는 행복원리다.
둘째, 공리주의의 공리성의 원칙, 효용원리 또는 최대행복원리가 개인의 평등한 자유권을 침해하고, 결국 최대다수의 최대행복을 위해 공리주의가 개인을 희생시킨다는 주장을 논박할 것이다. 밀의 공리주의는 해악의 원리와 평등하게 대우받을 권리를 통해 개인의 평등한 자유에 관한 권리를 보장하고 있다.
셋째, 공리주의의 효용원리 또는 최대행복원리가 쾌락과 고통에 대한 개인적 차원의 서로 다른 경험규칙을 정당한 근거 없이 사회적 차원의 도덕원리로 만들고 있다는 주장을 반박할 것이다. 개인과 사회 모두를 위한 공적 이익인 사회적 효용을 추구하면서 최대다수의 최대행복을 실현하는 정의로운 도덕원리를 제시하는 밀의 공리주의 정의론은 높은 지능과 동정심을 가진 사회적 존재인 인간이 지닌 사회적 감정에 기초해서 성립한다.
From the beginning of utilitarianism, J. Bentham and J. S. Mill's utilitarianism proposed the principle of utility, the greatest happiness principle, as the moral principle and justice of utilitarianism regarding morality and legislation. However, J. Rawls criticized utilitarianism on the grounds that it violated equal right to freedom and citizen personalities. Thus, Rawls developed an alternative conception of justice to utilitarianism. Therefore, this study establishes Mill's theory of justice by reviewing Rawls’ criticism of utilitarianism.
First, this study seeks to correct daily misunderstandings of the utility principle of utilitarianism. The utilities of utilitarianism are not efficiency, effect, benefit, or result, but pleasure, pain, and happiness of individuals and society. It is the principle of utility, or the greatest happiness principle, that utilitarianism realizes social interests together while pursuing individual interests.
Second, this study refutes the argument that the utilitarian principle, violates an individual's equal right to freedom, and sacrifices some individuals for the greater happiness of the greatest number. In contrast, utilitarianism guarantees the right to equal freedom of all individuals through "harm principle" and the right to be treated equally.
Third, this study confutes the argument that the principle of utility has put rules of experience at the personal level of pleasure and pain to moral principles at the social level without justifiable grounds. Utilitarianism is a just moral principle that realizes happiness of the greatest number while pursuing social utility for individual and social interests. Mill’s utilitarian theory of justice is based on the social feelings of humans with high intelligence and sympathy.
