우리 헌법은 공무원에 대해 국민 전체에 대한 봉사자이며 국민에 대하여 책임을 진다는 규정을 두고 있다(제7조 제1항). 헌법은 대통령, 국회의원 등에 대해서도 국민 전체의 이익을 위해 일해야 한다는 규정을 두고 있다. 하지만 이들 문구의 의미는 명확하지 않다. 본 논문은 자연법 전통의 공동선 개념과 고전 공리주의를 통해 이 문구의 기원과 의미를 제시해보려는 시도이다. 아리스토텔레스는 「정치학」에서 통치의 목적에 대해 논하면서 공동선 개념을 제시했다. 공동선이란 시민이 삶의 완성을 위해 사회에 참여한 이상 준수해야 하는 사회생활의 원리이다. 중세 자연법 신학자 아퀴나스는 공동선 개념을 법의 목적이자 어떤 형태의 통치이든 그 정당성을 평가하는 기준으로 발전시켰다. 자연법 전통의 공동선 개념은 질서 있고 자유로운 사적 선의 추구가 개인과 공동체의 번영을 만들어낸다고 이해하며, 특히 통치자에게는 공동선을 위해 일해야 한다는 정치적 책임을 부여한다. 17세기 이후에 컴버랜드 등 개신교 신학자를 포함한 잉글랜드 지식인들은 이 공동선 개념에 근거를 두고 성공회 공리주의를 만들어냈다. 벤담과 밀의 고전 공리주의는 개인의 행동이 도덕적인가 판정하는 기준으로 공리의 원칙을 제시했는데, 이것은 이전의 공리주의적 사조에서 생겨났으며 공동선 개념을 탈신학화한 것으로 평가할 수 있다. 공동선 개념과 고전 공리주의는 시민의 윤리학이라는 점에서 공적 윤리이며, 공직자에게는 공직의 역할을 명확하게 제시한 점에서 헌법적 공적 윤리라 할 수 있다. 본 논문은 공동선 개념과 여기서 발전한 고전 공리주의가 공직자에게 국민 전체를 위해 일한다는 것의 의미, 방법, 한계를 제시할 수 있다고 주장한다. 공직자가 국민 전체를 위해 일한다는 것은 정부를 포함한 모든 공직자의 활동이 일부의 개인이나 집단의 이익을 추구하는 것이 되어서는 안 되고 사회 구성원 전체의 유익을 위한 것이어야 한다는 의미이며, 그 방법은 오랜 불편을 해소함으로써 국민 생활의 공통된 편익을 증진하는 것이다. 또한 국민 전체의 이익을 위한다는 것을 공직자가 특정한 이념에 입각해 국민 생활의 전반적인 변화를 주도할 수 있다는 것으로 해석해서는 안 되는데, 롤즈가 공동선 개념을 경계한 것에서 알 수 있듯 사회의 발전과 변화는 자유로운 시민들의 주도에 따라 생겨나는 것이고 공직자의 역할은 그런 변화를 위한 봉사에 그치기 때문이다.
The Constitution of the Republic of Korea provides that all public officials shall be servants of the entire people and shall be responsible to the people [Article 7 (1)]. The Constitution also provides that the president and members of the National Assembly should respect and work for the good and interests of the entire people. However, the meaning of this article remains unclear.
This article aims to provide preliminary explanations of the concept of the common good of natural law theory tradition and the principle of Utility of classical utilitarianism. In his Politics, discussing objects of governance, Aristotle introduced the concept of the common good. The Common Good is the principle for the citizens participating in the community for their completion, working as the guidelines for the people who live together. St. Aquinas, the great medieval theologist, developed this concept as the purpose of the law and the criteria of the institutional legitimacy of all politics. Since the 17th century, R. Cumberland and several theologians produced Anglican utilitarianism by developing the common good of natural law theory tradition. The common good theorists understand that people only living freely and in a well-ordered society enjoy prosperity. When J. Bentham and J.S. Mill set the principle of Utility as a criterion of the morality of individual acts, they made this of the concept of the common good by eliminating elements of theology. In this way, the common good and classical utilitarianism become a system of public ethics. This article asserts that the concept of the common good of natural law theory and classical utilitarianism can provide the full meaning, method, and limits of article 7(1).
