본 연구는 우리나라 섬 지역주민의 의료복지 활성화를 위한 디지털 원격의료 체계를 효율적으로 구축하는 방안을 모색하였다. 현재 우리나라는 섬 지역의 보건의료서비스에 대한 제도적 시스템을 포괄하는 별도의 지원법을 제정하려고 노력하고 있다. 특히, 이를 효과적으로 집행하기 위한 국가 수준의 섬 지역 보건의료서비스 발전 종합계획을 수립하고 있다. 이런 노력의 결과, 2002년 의료법 개정을 통해서 처음으로 원격의료제도가 법제화되었다. 즉, 2002년 3월 의료법 개정을 통해 원격의료(제34조)를 인정하였고, 2003년도에는 의료법 시행규칙에 시설 및 장비를 규정함으로써 보건복지부가 원격의료 활성화 의지를 나타냈다. 그러나 아직도 원격의료에 관해서는 찬반 논쟁이 팽팽하게 맞서고 있으며, 의료법 개정을 비롯한 다양한 정책집행과 제도 구축이 미흡한 상황이다. 4차 산업혁명 시대에 여러 국가에서 빅데이터 기반의 다양한 기술을 접목하여 디지털 원격의료를 본격적으로 시행하는 것과 비교하면 우리는 ICT 강국의 면모를 발휘하지 못하고 있다. 헌법 제36조 제3항을 통해서 보건권을 도출할 수 있고, 이를 근거로 해서 모든 국민은 국가로부터 의료서비스를 받을 수 있는 권리와 반대로 국가도 국민에게 균등한 양질의 의료서비스를 제공해야 할 의무가 있다. 특히 의료의 특성상 ‘공공성’이 중요한 의미를 지니는데, 실제 우리나라 지방 공공의료기관은 병상 수나 양질의 의료인이 부족한 현실이다. 그리고 현재 대도시와 지방 간의 보건의료서비스 격차가 심각한 수준으로 벌어지고 있다. 이에 그 해결방안의 하나로 실질적인 디지털 원격의료를 시행함으로써 섬 지역주민의 의료복지서비스를 활성화하는 방안이 될 것이다. 특히, 의사와 환자 간의 의료행위를 하는 데 있어 대면성이 필수요건인지가 논쟁의 중심에 있는데, 의료법 제17조의 ‘직접 관찰’에 대한 해석이 문제의 핵심이 되고 있다. 이에 본 연구는 헌법재판소의 결정과 대법원의 판결 비교를 통해 타당성 여부를 판단하였다. 이를 통해 원격의료에 관련된 내용의 실현 가능성 유무를 검토했다. 마지막으로 진료 정보를 보호하고 활용하는 측면에서 적절한 방안을 제시하고자 하였다. 결국, 섬 지역의 실질적인 원격의료 시행이 이루어지기 위해 정부가 보건의료서비스에 대한 확실한 법 체제 아래에서 정책과 비전을 실행하면서 국민의 신뢰를 얻어야 한다. 그런 점에서 섬 지역주민의 의료복지서비스 제공을 위한 하나의 방안으로 원격의료 활성화를 위한 몇 가지 원칙을 제안하였다. 이는 정부가 국민 전체의 삶의 질 향상과 안정이라는 대전제 아래 공감 가는 실질적 디지털 원격의료를 시행하는 정책을 수립하여, 지역 간 의료격차를 해소함으로써 섬 지역주민들이 안심하고 행복할 수 있는 삶을 영위할 방안을 제시하였다.
This study aimed to explore efficient ways to establish a digital telemedicine system to activate healthcare services for residents in island regions of South Korea. Currently, South Korea is trying to establish a separate support law that encompasses the institutional system for healthcare services in island regions. Specifically, a comprehensive development plan for island region healthcare services at the national level is being formulated to execute these efforts effectively. As a result of these efforts, remote medicine was first legislated through an amendment to the Medical Act in March 2002, recognizing telemedicine(Article 34), and in 2003, the Medical Act Enforcement Regulations specified facilities and equipment, indicating the Ministry of Health and Welfare's intention to activate telemedicine. Yet, debates for and against telemedicine persist, and implementing various policies and institutional construction, including amendments to the Medical Act still needs to be improved. Especially considering the importance of ‘publicness’ in healthcare, the reality in South Korea is that local public healthcare institutions in island regions need more hospital beds and quality healthcare professionals. Furthermore, the healthcare service gap between major cities and rural areas has widened significantly. One possible solution to address these issues is the practical implementation of digital telemedicine, which can enhance healthcare services for residents in island regions. There is an ongoing debate on whether face-to-face interaction is a requirement for medical activities between doctors and patients, with the interpretation of 'direct observation' in Article 17 of the Medical Act at the center of the debate. This study assessed the feasibility of realizing remote medicine by comparing decisions by the Constitutional Court and rulings by the Supreme Court. Lastly, the study proposed appropriate measures for protecting and utilizing medical information. In conclusion, for the practical implementation of remote medicine in island regions to occur, the government needs to gain public trust while executing policies and visions under a clear legal framework for healthcare services. In this regard, the study proposed several principles for the activation of telemedicine as one of the options for providing healthcare services to residents in island regions, aiming to establish policies that resonate with the entire population, ultimately improving their quality of life and well-being, and eliminating healthcare disparities between regions.
