이 연구의 목적은 헌법과 교육기본법의 유사한 법체계를 갖춘 3개 국가 간의 비교 연구를 통해서 특징을 분석하고, 이들 국가 간에 상호 시사하는 부분과 입법 과제를 도출하기 위한 연구이다. 교육기본법은 국민의 교육기본권 보장의 범위를 규정하고 국가 및 지방자치단체 교육정책의 방향과 최근의 변화를 포함하여 상호 비교의 의미가 있다.
비교 논의의 준거는, 교육기본법의 헌법과의 관계 및 위상, 교육기본법의 체제 및 구성, 정부 교육개혁에 대한 입법 통제 및 지원 방식, 교육구성원들 간의 역할 분담 방식, 그리고 상호 간에 있어서 모범사례와 반면교사의 시사점에 둔다.
한국, 일본, 대만 교육기본법의 공통된 특징으로는, 헌법의 교육조항을 구체화한 법, 다른 교육법을 제정하고 해석하는 기준의 역할, 교육기본권을 실현하는 방법적 원리로서 ‘기회의 균등’의 강조, 평생에 걸친 학습권 보장의 강조, 국민의 교육기본권 보장을 위한 국가의 역할 강조, 그리고 시대와 환경변화를 반영한 개정이라는 점 등을 들 수 있다.
일본과 대만의 공통된 특징은 교육공동체 회복의 지향성, 교육개혁에 대한 입법적 통제와 지원 등이다. 그러나, 국가 및 지방자치단체의 교육정책에 대한 입법적 통제와 재정적 지원 체제는 정책의 안정성 확보와 교육의 중립성 훼손 우려라는 양면이 있다. 일본 교육기본법상의 정치교육, 대학의 사명과 자율성 및 자주성 보장, 가정교육의 책임과 지원은 한국의 교육기본법에도 반영할 만한 가치가 있다.
대만의 경우 국가의 고유사무를 8개로 제시하고 있는 부분은 교육 분권 측면에서 가장 시사점이 큰 부분이다. 소규모 학급 및 학교 원칙, 취약 지역에 대한 지속적 재정 지원, 체벌 금지의 원칙 등은 역동적인 대만 사회의 특성이 드러낸 부분이기도 하다.
한국의 기본법이 일본과 대만에 줄 수 있는 시사점은, 국가와 지방자치단체의 명확한 교육 책임, 교육당사자 개념의 설정, 적성을 강조하는 평생 학습권, 지방 및 학교 단위의 교육자치의 보장, 시대와 환경변화에 대응한 다양한 시책의 의무화 등을 들 수 있다.
The purpose of this study is to analyze the characteristics of three countries with similar legal systems in terms of the Constitutions and Fundamental Law of Education (hereinafter referred to as FLE) through a comparative study, and to draw implications and legislative challenges among them. The basis of the comparison is the relationship and status of the FLE with the Constitution, the contents and differences between the countries, the legislative control and support for education reform by the government.
The FLE of South Korea, Japan, and Taiwan have the following common features. They specifically stipulate the education provisions of the Constitution, emphasize ‘equality of opportunity’ and ‘the right to learn throughout life’, and the role of the state in ensuring the fundamental right to education.
Japan and Taiwan emphasize the restoration of the educational community in the face of conflicts among parties concerned in education, and provide legislative control and support for educational reform. Political education, ensuring the mission, autonomy, and independence of universities, and the responsibility and support of home education in Japan's FLE are worthy of being reflected in South Korea's FLE. In Taiwan, the list of eight inherent duties of the state is the most significant in terms of decentralization of education.
The implications of the Korean FLE for Japan and Taiwan include the clear responsibilities of the national and local governments for education, the establishment of the concept of six parties concerned in education, the right to lifelong learning that emphasizes aptitude, the guarantee of educational autonomy at the local and school levels, and the mandating of various measures to respond to changing times and environments.
