내국법인 및 국내사업장이 있는 외국법인의 가상자산소득은 현행 법인세법의 포괄주의에 따라 과세된다. 그러나 거주자·비거주자 및 국내사업장이 없는 외국법인의 가상자산소득은 2025년부터 일정 유형의 거래에 한하여 기타소득으로 과세될 예정이다. 가상자산사업자는 가상자산 거래내역 제출의무를 진다. 일정 요건이 갖추어진 경우 거주자와 내국법인은 해외가상자산계좌를 신고하여야 한다.
우리나라 가상자산 소득과세 제도를 보완하기 위한 개선 방안은 아래와 같다. 첫째, 거주자·비거주자 및 국내사업장이 없는 외국법인의 경우 가상자산 유형과 규제 체계가 세워질 때까지 가상자산소득을 기타소득으로 과세한다. 둘째, 가상자산의 양도·대여뿐 아니라 다른 거래 유형을 과세대상에 넣을 수 있도록 세법을 개정한다. 셋째, 가상자산 발행거래의 손익귀속시기에 관한 가상자산 회계지침과 기획재정부 입장이 다르므로, 가상자산 발행거래의 소득 실현 시점을 법인세법 시행령 또는 기본통칙에서 정한다. 넷째, 우리나라가 OECD의 가상자산 정보교환 제도를 시행할 때 가상자산사업자의 가상자산 거래내역 제출 제도를 활용하도록 법령을 개정한다. 다섯째, 납세의무자의 자발적인 신고납부를 유도하기 위하여 가상자산소득에 관한 신고납부 안내와 신고세액공제 제도를 도입한다. 여섯째, 가상자산의 익명성에 대응하기 위하여 가상자산소득에 관한 부과제척기간을 늘리고 가산세 제도를 강화한다. 일곱째, 해외금융계좌신고의 기준 금액을 5억 원 아래로 낮추거나 해외가상자산계좌를 따로 신고하도록 제도를 개선한다. 여덟째, 세법의 가상자산 거래내역 제출의무 또는 OECD 가상자산 정보교환 제도의 보고의무를 이행하지 않는 가상자산사업자에 대한 제재 규정을 만든다.
In Korea, virtual asset income of a domestic corporation (including a foreign corporation with a permanent establishment) is currently taxable. In case of an individual as well as a foreign corporation without a permanent establishment, several specific transactions of virtual assets will be subject to income taxation as a category of other income from January 2025. Virtual asset service providers (“VASPs”) should report virtual asset transactions to tax offices. Residents and domestic corporations must file foreign virtual asset accounts to tax offices where certain requirements are met under the current foreign bank account reporting regime.
This article provides legislative recommendations for enhancing the current income taxation system of virtual assets as follows. First, virtual asset income of residents and foreign corporations should be classified as other income until regulatory systems of virtual assets are clearly established. Second, other types of virtual asset transactions like staking and airdrop should be subject to tax. Third, it is necessary to clarify when to recognize income of initial coin offering transactions in tax law or tax authorities’ rulings. Fourth, Korea should implement a system for exchanging tax information regarding virtual assets based on the current VASPs’ reporting regime. Fifth, it is necessary to give not only tax return notices but tax return deduction to taxpayers with virtual asset income. Sixth, the statute of limitations and penalty tax systems related to virtual asset income should be revised in order to cope with the anonymity of virtual assets. Seventh, it is necessary to lower the minimum requirements of reporting foreign virtual asset accounts. Eighth, penalty clauses should be introduced to tax law for violating the current VASPs’ reporting regime as well as the exchange of tax information related to virtual assets.
