일반회생절차는 절차적으로 복잡하고 비용이 많이 드는 구조이므로 소규모 영업자에게 매력적인 절차가 아니다. 따라서 소규모 영업자를 대상으로 한 간이화된 회생제도가 필요하다. 세계 각국은 팬데믹 사태 이후 심각한 경제적 어려움에 직면한 중소기업 등을 위한 신속·저비용의 회생절차를 정비하였다. 미국은 2019년 중소기업 회생법을 제정하여 소규모 영업자를 위한 신속하고 저렴한 비용의 회생 절차를 제공하고 있다. 이 글에서는 미국 중소기업 회생법의 입법 배경, 자격요건, 전반적인 내용 및 영향에 관하여 자세히 분석한다. 나아가 채무자회생법상 간이회생절차의 입법 배경, 자격요건, 전반적인 내용 및 영향에 관하여도 간단히 살펴본다. 이를 토대로 우리 간이회생절차가 소규모 영업자를 위한 적절한 회생절차를 제공하고 있는지 검토하고, 미국 중소기업 회생절차와의 비교법적 관점에서 간이회생절차를 개선할 수 있는 방안을 생각해 보기로 한다.
The general reorganization procedures are procedurally complicated and expensive and thus unattractive to small businesses(MSMEs). Therefore, there is a need for a simplified rehabilitation system for MSMEs. Since the COVID-19 pandemic, countries around the world have established fast-track and low-cost reorganization procedures for small businesses that face severe economic difficulties. The United States enacted the Small Business Reorganization Act of 2019 to provide a fast and low-cost revival process for small businesses. This article analyzes in detail the legislative background, eligibility requirements, overall content, and impact of the Small Business Reorganization Act of 2019, and briefly reviews the legislative background, eligibility requirements, overall content, and impact of the simplified rehabilitation procedures for small operating income earners under the Debtor Rehabilitation and Bankruptcy Act of Korea. Based thereon, this article examines whether the Korean simplified rehabilitation procedures provide an appropriate reorganization process for small businesses and considers ways to improve the simplified reorganization process from the comparative legal perspective with the U.S. Small Business Reorganization Act.
