비트코인으로 대표되는 가상화폐는 대중들에게 가치 있는 재화로 인식되면서 활발하게 거래되고 있다. 대법원은 가상화폐를 ‘재산적 가치가 있는 무형의 재산’이라거나 ‘사기죄의 객체인 재산상 이익’이라고 판단한 바 있다. 그 후 대법원은 2021. 12. 16. 선고 2020도9789 판결(이하 ‘대상판결’이라고 한다)에서, 착오로 이체된 가상화폐를 임의로 사용한 피고인에 대하여 배임죄가 성립되지 않는다고 하였고, 대상판결의 하급심은 가상화폐를 형법상 재물로 인정하지 않아 횡령죄의 성립을 부정하였다. 이로 인하여 착오이체된 가상화폐의 임의소비에 대하여는 처벌의 공백이 발생하게 되었다.
본 연구는 가상화폐를 형법상 재물로 인정할 수 있는지 검토하는 것을 목적으로 한다. 이와 더불어 착오이체된 가상화폐를 임의로 소비한 자에 대하여 횡령죄와 배임죄의 성립을 모두 부정한 대상판결을 비판적으로 검토해보고자 한다.
본고에서는 특히 가상화폐의 탈중앙성, 불가역성, 보안성, 투명성 등의 특성과 개정된 특정 금융거래정보의 보고 및 이용 등에 관한 법률상 가상화폐 거래에 대한 법적 규제에 주목한다. 이를 형법상 재물개념에 관한 해석론과 종합하여 가상화폐를 형법상 재물로 인정할 수 있는지 논증해 본다.
과학기술의 발달에 따라 가상화폐를 비롯한 새로운 자산은 계속 등장할 것이다. 이러한 자산들은 유체성을 가지지 않는 경우가 대부분일 것이다. 형법상 재물개념에 관하여 어떤 해석론을 취하는지, 그리고 그에 비추어 새로운 자산들의 재물성을 어떻게 파악할지에 따라 새로운 자산을 대상으로 하는 재산범죄에 대한 형법적 대응의 범위와 방법이 달라질 수 있을 것이다. 본고에서 제시하는 해석론과 보론으로 제시하는 입법론과 관련하여 향후 많은 논의와 검토가 이루어지길 희망한다.
Cryptocurrency, represented by Bitcoin, is actively traded as it is recognized as valuable goods by the public. The Supreme Court judged cryptocurrency as “intangible property with property value” or “property interest as an object of fraud.” After that, the Supreme Court, through Supreme Court Decision 2020Do9789 decided December 16, 2021 (hereinafter “subject case”), determined that the crime of breach of trust was not constituted against the defendant who arbitrarily used the cryptocurrency transferred by mistake, and the lower court denied the constitution of the crime of embezzlement by viewing that cryptocurrency is not recognized as property under the Criminal Law. In the end, the arbitrary consumption of cryptocurrency transferred by mistake cannot be punished.
This study aims to examine whether cryptocurrency can be recognized as property under the Criminal Law. In addition, we would like to critically examine the subject case that denied the constitution of both embezzlement and breach of trust for those who arbitrarily consumed the mistakenly transferred cryptocurrency.
This article focuses on the characteristics of cryptocurrency (decentralization, irreversibility, security, transparency, etc.) and the legal regulation of cryptocurrency transactions under the revised Act on the Reporting and Use of Certain Financial Transaction Information. We will argue whether cryptocurrency can be recognized as property under the Criminal Law by synthesizing this with the interpretation of the concept of property under the Criminal Law.
As science and technology develop, new assets, including cryptocurrency, will continue to emerge. In most cases, these assets are not tangible. Depending on what interpretation is taken regarding the concept of property in criminal law and how the property nature of new assets is understood, the scope and method of criminal response to property crimes targeting new assets may vary. It is hoped that many discussions and reviews will take place in the future in relation to the interpretation theory presented in this paper and the legislative theory presented as a supplement.
