「마약류 관리에 관한 법률」(다음부터 ‘마약류관리법’이라고 약칭한다) 제67조는 마약류와 그 수익금에 대한 추징을 규정하는데, 그 해석 및 적용은 간단한 것이 아니다. 실무상 많이 문제 되는 쟁점을 대별하면, ① 마약류 가액의 산정 기준, ② 순차로 저지른 마약류 범행에서의 추징 방법, ③ 마약류와 그 수익금에 대한 동시 추징 여부, ④ 동일한 마약류를 취급한 다수 가담자로부터 그 마약류에 대하여 중첩적으로 추징할 것인지 여부, ⑤ 중첩적 추징의 구체적 범위(예외적으로 일정한 가담자에 대하여는 중첩적 추징을 제한할 것인지 여부), ⑥ 가담자 1인에 대한 몰수의 효력이 다른 가담자에게도 미치는지 여부(몰수에 절대효가 있는지 여부) 및 가담자 1인의 추징금 납부의 효력이 다른 가담자에게도 미치는지 여부(추징금 납부에 절대효가 있는지 여부)가 있다. 이에 대하여 지금까지 대법원이 밝힌 일반적인 법리나 대법원의 구체적 판결례를 정리하고 그에 대하여 검토할 필요가 있다.
대법원은 마약류관리법상 추징의 법적 성격이 징벌적 추징이라는 확고한 입장을 바탕으로 그 법리를 전개하고 있다. 따라서 이 논문에서도 이를 전제한다.
① 대법원은 매매알선에서는 “실거래가”를 기준으로 마약류 가액을 산정한다는 법리를, 매도에서는 “시가”를 기준으로 마약류 가액을 산정한다는 법리를 설시하였다. 구체적인 사안에 대한 대법원의 판결례를 보면, 매수와 매도의 경우 모두에서, 실거래가를 기준으로 마약류 가액을 산정한 것과 시가를 기준으로 마약류 가액을 산정한 것이 있다. 그러나 마약류 가액은 해당 마약류 자체의 “시가”, 즉 그 마약류가 취급된 형태 및 양에 따른 시가로 산정되어야 한다.
② 순차로 저지른 다수 범행으로 취급된 동일한 마약류에 대하여 범행마다 개별적으로 추징할 수는 없다. 대법원도 동일한 입장이다. 따라서 이러한 경우, 해당 마약류에 대한 추징금 산정 기준이 정립되어야 하는데, 그 기준에 관하여 대법원의 입장은 일관되어 있지 않다. 결론적으로 마약류 가액은 이를 취급한 순차 범행에 따른 시가 중에서 가장 높은 것으로 산정되어야 한다.
③ 마약류와 그 수익금에 대한 동시 추징 여부에 관하여 대법원의 입장은 명확하다고 할 수 없다. 그러나 마약류와 그 수익금에 대한 동시 추징은 긍정되어야 한다.
④ 다수의 범인이 동일한 마약류를 취급한 경우 그 마약류에 대한 추징은 그들 개개인으로부터 중첩적으로 이루어져야 한다. 이는 대법원도 동일한 입장이다.
⑤ 일정한 가담자의 경우 추징이 제한되어야 하고, 그에 관한 법리가 보다 구체적으로 발전되어야 한다. 현재 대법원판결의 흐름을 보면, 대법원은 이와 같은 방향으로 나아가고 있다고 평가할 수 있다.
⑥ 가담자 1인에 대한 몰수의 효력은 다른 가담자에게도 미쳐야 한다(몰수의 절대효). 이는 대법원도 동일한 입장이다. 그럼에도 불구하고 가담자 1인의 추징금 납부 효력은 다른 가담자에게 미쳐서는 안 된다(추징금 납부의 상대효). 대법원이 마약류관리법상 추징에서 추징금 납부에 절대효가 있다는 입장을 명시적으로 밝힌 적은 없으나, 징벌적 추징인 외국환거래법상 추징에서 추징금 납부에 절대효가 있다는 입장을 밝힌 적은 있다.
Article 67 of the Narcotics Control Act stipulates the additional collection of narcotics and any proceeds derived therefrom, but its interpretation and application are not that simple. The issues that are most problematic in practice are broadly classified as follow: ① the standard for calculating the value equivalent to narcotics; ② the collection method for the crime of narcotics committed sequentially; ③ whether narcotics and any proceeds derived therefrom should be collected at the same time; ④ whether the narcotics may be collected from multiple participants who handled the same narcotics in an overlapping manner; ⑤ the specific scope of the overlapping additional collection (i.e. whether the overlapping additional collection needs to be restricted to certain participants exceptionally); and ⑥ whether the effect of confiscation on one participant may be extended to other participants (i.e., whether confiscation has absolute effect) and whether the effect of payment of additional collection charges by one participant may be extended to other participants (i.e., whether the payment of additional collection charges has absolute effect). In relation thereto, it is necessary to summarize and review the general legal principles and specific precedents of the Supreme Court of Korea that have been rendered so far.
The Supreme Court of Korea is developing its legal principles based on the firm position that the legal nature of additional collection under the Narcotics Control Act is punitive. Therefore, this paper is also premised thereon.
① The Supreme Court of Korea established the legal principle that the value equivalent to narcotics in assisting in the trade of any narcotics should be calculated based on the “actual transaction price,” and the value equivalent to narcotics in selling any narcotics should be is calculated based on the “market price” Examining the precedents rendered by the Supreme Court of Korea related to specific issues, in both buying and selling, there are some cases in which the value equivalent to narcotics was calculated based on actual transaction prices and others in which the value equivalent to narcotics was calculated based on market prices. However, the value equivalent to narcotics should be calculated based on the “market prices” of the narcotics, that is, the market price according to the form and amount in which the narcotics were handled.
② The same narcotics handled in multiple crimes committed sequentially cannot be collected in an overlapping manner in relation to each individual crime. The Supreme Court of Korea also takes the same position. Therefore, in such a case, the standard for calculating the value equivalent to narcotics should be established, but the Supreme Court of Korea’s position regarding such standard is inconsistent. In conclusion, the value equivalent to narcotics should be calculated as the highest price among the market prices of the multiple crimes committed sequentially where the narcotics were handled.
③ The position of the Supreme Court of Korea cannot be said to be clear with resepct to whether narcotics and any proceeds derived therefrom should be collected at the same time. However, narcotics and any proceeds derived therefrom should be collected at the same time.
④ If multiple criminals handled the same narcotics, the narcotics should be collected in an overlapping manner from each of them, which is the same as the position of the Supreme Court of Korea.
⑤ In the case of certain participants in crimes related to narcotics, additional collection should be restricted, and the legal principles related thereto should be developed more specifically. In light of the current trend of the precedents rendered by the Supreme Court of Korea, the Supreme Court of Korea can be seen to move in such direction.
⑥ The effect of confiscation on one participant should be extended to other participants (i.e., absolute effect of confiscation). This is the same as the position of the Supreme Court of Korea. Nevertheless, the effect of payment of additional collection charge by one participant should not be extended to other participants (i.e., relative effect of payment of additional collection charges). Although the Supreme Court of Korea has never explicitly stated that there is absolute effect with regard to the payment of charge in additional collection under the Narcotics Control Act, it has stated that there is absolute effect in relation to the payment of additional collection charges as referred to in additional collection under the Foreign Exchange Control Act, which is also punitive.
