비례대표제의 도입이나 확대를 주장하는 측에서는 사회 내에 존재하는 다양한 의사들이 정확히 그대로 의회에 반영되어야 함을 강조한다. 이는 연동형 비례대표제에 대해서도 다르지 않다. 하지만 본고에서는 그것 자체는 결코 목적이 될 수 없으며, 단순히 다양한 의사들이 반영만 돼서는 국민주권주의를 실현할 수도 없다고 하였다. 어느 선거제도를 택하든지 간에 통치를 위해서는 적절한 ‘결정’이 내려져야만 하는 것이다. 따라서 전체 국민의 축소판이라는 ‘대표’ 개념은 우리 헌법해석론상 받아들여질 수 없다고 보았다. 오히려 연동형 비례대표제는 숙의와 토론을 통한 합의제 민주주의를 가능케 하는 조건을 마련해준다는 점에서 정당화 가능하다고 하였다.
현실적으로는 정당제 민주주의라는 상황은 고려되어야만 한다. 먼저, 군소정당이 난립할 수 있게 하는 연동형 비례대표제에 대해서 정국의 불안정을 가져올 것이라는 우려가 강하다. 하지만, 정당제 민주주의로 인한 대표 간의 통약 불가능성 문제는 비단 다당제를 형성하는 비례대표제에서만 문제가 된다고 보기 어렵다. 양당제에 따른 다수정 민주주의하에서도 두 거대정당 간의 ‘영합 게임(zero-sum game)’의 양상으로 대결이 이뤄지게 된다면 여러 가지 부작용을 낳을 수 있으며, 특히 양당제의 장점으로 일컬어지는 정책집행의 효율성을 오히려 해칠 수 있다고 하였다. 정반대로 다당제에 따른 합의제 민주주의하에서 정책집행의 ‘지속성’을 띠는 측면이 있음을 밝혔다. 대통령제와 조응하기 어렵다는 비판에 대해서도 정당제 민주주의라는 현실에서 입법부와 집행부 간의 융합이 이뤄질 가능성이 크기 때문에, 의회 내 의원 간 권력분립 실현의 차원에서 오히려 연동형 비례대표제 도입이 정당화될 수 있다고 보았다.
한편으로는 정당제 민주주의라는 현실을 고려할 때, 의원정수를 늘리는 것이 들어가는 비용에 비해 얼마나 큰 의미가 있을지는 의문이라고 하였다. 따라서 의원정수에 영향을 주지 않는 ‘스칸디나비아식 불비례보정형’ 선거방식을 응용할 것을 제안해 보았다. 물론, 그러한 방식을 따를 때 일정 부분 불비례성은 발생하겠으나, 합리적인 이유가 있다면 그것 자체가 평등선거 원칙(표의 성과가치의 평등)을 침해한 것이라 볼 수는 없다고 하였다. 끝으로 연동형 비례대표제가 성공하기 위해서는 정당 내 민주화가 이뤄져야 한다고 하였고, 정당법 등 관련 정당관계법에 대한 개혁이 절실하다고 하였다. 또한, 정당 내 문제라고 하더라도 필요하다면 사법부가 적극 통제해야 한다고 하였다.
In discussions advocating the introduction or expansion of proportional representation, it is emphasized that diverse opinions existing within society should be accurately reflected in the legislature. This holds true for the introduction of mixed-member proportional representation as well. However, this paper argues that mere representation of diverse opinions cannot be the sole objective. Simply reflecting various opinions is insufficient to realize democratic principles. Regardless of the electoral system chosen, appropriate ‘decisions’ must be made for effective governance. Thus, the concept of ‘representation’ as a scaled-down version of the entire society cannot be accepted in our constitutional interpretation. Instead, mixed-member proportional representation is justified in enabling democratic principles of consensus through deliberation and debate.
In reality, one must consider the situation of party-based democracy. There is a strong concern that a mixed-member proportional representation system allowing the proliferation of small parties could lead to political instability in the country. However, issues related to party-based democracy can also exist under majoritarianism based on a two-party system. If a confrontation between the two major parties turns into a ‘zero-sum game,’ it can lead to various side effects. Instead, it was argued that consensus democracy might offer continuous stability in policy implementation. The criticism that the mixed-member proportional representation system is difficult to align with a presidential system also lacks persuasiveness. Under party-based democracy, there is a significant potential for convergence between the legislative and executive branches. Therefore, even within the legislature, the separation of powers among legislators is demanded.
I oppose the introduction of mixed-member proportional representation that increases the number of legislators. In the reality of party-based democracy, increasing the number of legislators is not meaningful. Therefore, some level of disproportionality is inevitable, but it can be constitutionally justified. It was also mentioned that reforms in party-related laws are necessary for the successful implementation of mixed-member proportional representation. If there are undemocratic practices within the parties, the judiciary should actively intervene if necessary.
