이 연구는 종교교육에 관한 두 개의 대법원 판례와 한 개의 헌법재판소 결정을 체계적으로 분석함으로써 판례에서 단편적 또는 모호하게 처리되어 있는 사립학교 종교교육의 한계에 대한 법적 해석기준을 정리하였다. 특히, 대학과 초·중등학교에 관한 판례가 서로 모순되는 것처럼 보이는 내용을 정합적으로 해석해내는 논리와 심사기준을 발견하였다. 첫째, 학교 선택권보다는 종교교육의 유형에 대한 판단 이후 개인 차원의 심사 기준과 조직 차원의 심사기준을 적용하는 2단계 심사 과정을 찾아내었다. 둘째, 교육기관으로서 사립학교의 성격을 고려한 조직 차원의 기준으로서 내용기준, 방법기준, 집단기준이 발견되었다. 셋째, 개인 차원의 심사기준으로서 동의가 종교교육의 유형에 따라 다르게 적용되는 논리를 확인하였다. 넷째, 학생의 동의는 초중등학교와 대학간 학교급의 차이 혹은 학생의 성숙도를 고려하여 다르게 고려되었다. 이 연구는 사립학교가 공교육체제에 편입되어 있고 그 비중이 큰 우리나라에서 학교 선택권의 전면적 재구조화 등이 현실적으로 불가능한 상황을 고려할 때 법·정책적 해결 방안 이전에 사립학교와 학생의 종교의 자유가 갈등하는 상황을 조화롭게 조정하는 해석기준으로서 기여할 것이다.

The purpose of this research is to construct a framework of comprehensive test for the legitimate religious education in private schools in relation to the freedom of religion of students. The decisions of the Supreme Court and the Constitutional Court were analyzed to draw the test elements and to reveal the consistent criteria for religious education. The conclusions are suggested below as follows.

First, the two-step approach was found to be utilized in the scrutiny process in the cases. The first step was focused on the identification of relevant types of religious education. Second, consensus was differently used for different religious education respectively. Religious education as liberal education did not demand the separate and explicit approval of students, while nonpartisan parochial education was justified only in the existence of clear consent of students. Third, institutional test was revealed to include content, method, and group criteria. It was not mute in the case of student approval for religious education. Fourth, school level was considered in the process of the assurance of the assent. It is natural that high school student is not mature and shall not be put in jeopardy to defend himself without help of adults.
