경찰은 범죄통제 및 질서유지 등 본연의 목적을 달성하기 위해서 물리적 강제력을 보편적으로 사용하고 있다. 이러한 물리적 강제력을 행사하는 과정에서 일정한 인권침해 문제가 상존하며, 따라서 경찰과 시민 간에는 긴장 및 갈등관계가 내재하게 된다. 이러한 이유로 경찰이 시민들로부터 정당성을 획득하는 것은 결코 쉬운 일이 아니다. 더욱이 경찰이 정치적 이해관계를 대변하거나 부정부패 등과 연루된다면, 경찰의 정당성은 기대하기가 어렵다.

주지하는 바와 같이 1829년에 창설된 영국의 런던수도경찰은 서구 최초의 근대경찰로 인식되고 있다. 근대경찰은 이념적・제도적으로 자유민주주의 가치에 부합되는 경찰로서 시민들로부터 정당성을 확보한 경찰을 말한다. 그런데, 사회에는 수많은 계층이 존재하는데, 경찰이 이들 모두로부터 정당성을 획득하는 것은 결코 쉬운 일이 아니다. 이에 대해 전통주의 관점에서는 수도경찰을 창설하고 여러 자치경찰조직을 정비한 1856년 이후부터 영국시민들로부터 정당성을 확보하였다고 주장하고 있다. 반면, 수정주의 관점에서는 경찰이 지배계급을 대변할 뿐 사회의 다수를 차지하고 있는 하류계층에 대해서는 정당성을 확보하지 못하고 있다고 비판하고 있다.

이 글에서는 이들 전통주의와 수정주의 입장을 토대로 영국경찰의 정당성에 대해서 역사적 관점에서 두 시대로 나누어 논의하고자 하였다. 즉, ㉠ 정당성 확보시대(런던수도경찰 창설 이후 1856년부터 1959년까지), ㉡ 정당성 저하시대(1960년대 이후~) 구분하였다. 그리고 경찰정당성 인식 요소로서 관료조직과 법치주의, 물리적 강제력의 최소화, 정치적 중립성과 민주적 책임, 예방적 경찰활동 등을 중심으로 살펴보았다.

요약건대, 영국경찰은 정당성 확보시대에는 이와 같은 인식요소와 관련하여 긍정적인 평가를 받은 반면, 정당성 저하시대에는 그렇지 못하였다는 점이다. 사실, 어느 시대에나 경찰의 정당성에 대한 찬반논쟁이 공존하고 있다고 본다. 다만 상대적이지만 영국경찰에서 보는 바와 같이 경찰이 본연의 역할을 충실히 수행할 때에는 전통주의자들의 주장이 설득력을 갖는다. 그러나 그러하지 못한 경우에는 수정주의자들의 입장이 설득력을 갖는다. 하지만 무엇보다도 중요한 것은 경찰의 정당성에 대한 판단 및 평가의 주체는 시민이라는 점이다.
