범죄자의 처벌을 강조하는 응보주의적 형사사법제도의 범죄억제 효과에 대한 문제제기는 세계 각국의 형사정책 연구들을 통해 이루어지고 있다. 이러한 응보주의적 형사사법제도와 반대되는 개념인 회복적 사법제도는 범죄자에 대한 처벌보다, 범죄자도 곧 사회로 돌아올 일반시민이라는 것을 강조하여 이들의 사회복귀를 돕는 처우를 강조하는 제도로, 노르웨이에서는 이러한 회복적 사법의 이념을 바탕으로 범죄자 교정영역에서 긍정적인 효과를 경험하고 있다.

노르웨이의 회복적 사법 중심 교정시스템에서 지향하는 세 가지 핵심원칙은 정상성의 원칙, 사회재통합, 그리고 ‘들여오기식(importmodellen)’ 교정서비스이다. 이러한 세 가지 핵심원칙을 바탕으로 노르웨이는 범죄자를 고립시키지 않고 지역사회를 기반으로 한 다양한 사회복귀 및 복지서비스를 제공한다.

또한 노르웨이에서는 범죄자를 일반시민과 구별된 복지서비스를 제공받도록 하기보다, 범죄정책과 복지정책의 연계를 강조하여, 일반시민으로서 제공되는 여러 복지서비스를 범죄자가 제공받을 수 있도록 한다. 더 나아가, 사회재통합 과정에서 가장 중요한 것은 범죄자 스스로의 교화의지라는 것을 강조하며, 사회재통합과정 계획수립에서부터 완료까지 범죄자의 적극적 참여를 지향한다.

그리고 노르웨이 정부는 꾸준히 교정분야에서 활동하는 모든 지역사회 기관 및 단체들을 위한 운영보조금을 지원하여 지역사회가 범죄자에게 보다 더 관심을 가지고 이들의 사회복귀에 힘쓰도록 하기 위한 발판을 제공하고 있으며, 이를 바탕으로 지역사회기관들은 주거, 의료, 교육, 취업, 가족지원 등 여러 영역에서 출소자 생활 조건 향상을 위한 서비스를 제공하고 있다.

Criminal policy studies from around the world have raised questions about the effectiveness of the retributive criminal justice system that emphasized the punishment of criminals. The restorative criminal justice system, contrary to the retributive criminal justice system, emphasizes the treatment of criminals to help them return to society by emphasizing that criminals are also ordinary citizens who will soon return to society rather than punishment for criminals. Norway is experiencing positive effects in the field of criminal correction based on this restorative criminal justice system.

The three key principles aimed at Norway’s restorative criminal justice centered correction system are the principle of normality, social reintegration, and ‘import model(importmodellen)’ correction services. Based on these three key principles, Norway provides a variety of community-based reentry and welfare services without isolating criminals from society.

In addition, Norway emphasized the link between criminal policy and welfare policy so that criminals can receive various welfare services provided as ordinary citizens even if they are criminals rather than receiving welfare services distinct from ordinary citizens. Furthermore, it emphasized that the most important thing in the process of social reintegration is the criminal’s own will to rehabilitate, and encourages the active participation of criminals from planning to completion of the social reintegration process.

And, the Norwegian government consistently provides operation subsidies for all community institutions and organizations that work in the field of correction, it establishes a foothold for the community to pay more attention to criminals and strive for their social reintegration. Based on government support, community institutions and organizations are providing services to improve the living conditions of released prisoners in various areas such as housing, medical care, education, employment, and family support.
