초록보기

현행 법률에 규정되어 있는 성폭력범죄는 정해져 있으나, 그 행위의 태양(態樣) 및 수단은 진화하고 있고, 교묘해지고 있다. 최근에는 성관계 사진 내지 영상을 넘어 성관계 시 동의 없는 음성 녹음(=성관계 시 음성 녹음)의 경우에도 형사처벌의

필요성이 제기되고 있다. 이에 대한 논의는 현행 성폭력처벌법상의 촬영죄를 비교 대상으로 삼지 않을 수 없다. 성관계 시 음성 녹음 행위에 대한 개정법률안이 촬영죄와 구성요건이 행위의 태양 및 수단에서만 차이가 있을 뿐 동일하기 때문이다. 그래서 여기서의 쟁점 역시 사람의 음성의 범위와 이러한 음성이 성적 욕망 또는 성적 수치심을 유발하는가 하는 점이다. 이러한 점에서 볼 때 성관계 시 음성 녹음 행위 역시 촬영죄와 마찬가지로 그 규정의 해석 및 적용에 있어 모호한 측면이 있고, 이 규정을 당해 행위 발생 시 적용하게 되면 헌법 및 형사법의 기본원리 및 기본원칙에도 반한다. 오히려 성관계 시 음성 녹음 행위는 수사절차 및 공판절차에서 증거로 활용할 수 있고, 성범죄 및 무고로부터 결백을 밝히는 데 있어 스스로를 보호할 수 있는 유일한 수단이 된다고 할 수 있다. 즉, 양 당사자 모두에게 긍정적인 효과가 더 크다고 본다.
