연구 목적: 이 연구는 잇다 후 여성 부양에 대한 샤리아의 적용을 분석하는 데 목적이 있다.

연구 방법: 연구방법은 코란, 코란 해설서, 논문, 저서, 파키스탄 위원회들의 보고서, 이집트 가족법의 자료를 중심으로 분석한 문헌연구이다.

연구 내용: 이 논문의 연구내용은 이슬람 율법인 샤리아와 잇다에 대해 알아보았다. 또한 수니 4대 법학파의 법원을 다루었으며, 코란에서 언급하는 이슬람의 이혼과 부양에 대해 논했다. 그리고 잇다 후 여성 부양에 대한 파키스탄과 이집트의 샤리아 적용 사례를 비교분석했다.

결론 및 제언: 이집트는 이혼 여성의 부양을 사회적으로 인정하고, 보호하기 위한 법을 개정하였다. 그러나 파키스탄은 이혼 후 여성 부양에 대한 법적 조항이 없기 때문에, 여성은 여전히 재정적 지원을 받지 못하고 있다. 향후 이슬람 사회는 샤리아의 정신이 회복되는 방향으로 이혼 여성을 위한 부양제도를 마련할 필요성이 있다.

This study aims to analyze the application of Sharī‘ah to mut‘ah for women after ‘iddah. This study analyzed Koran, Koran handbook, papers, books, Pakistan Committees’ reports, and the Family Law of Egypt with a literature research method. This study investigated Islamic Law, Sharī‘ah and ‘iddah, dealt with the Source of Law of Four Sunni Schools, and discussed divorce and mut‘ah mentioned by Koran. In addition, a comparative analysis was conducted on the cases of the application of Sharī‘ah to mut‘ah for women after ‘iddah in Pakistan and Egypt. As a result, Egypt socially recognized mut‘ah for divorced women and enacted a law to protect them. However, since Pakistan does not have legislative provisions on mut‘ah for women after divorce, they still do not receive financial support. Islamic society will have to prepare a system of aliment towards the recovery of the spirit of Sharī‘ah concerning mut‘ah for divorced women.
