초록보기

현대사회의 가장 두드러진 특징은 과학문명의 발달이라 할 것이다. 정보통신기술(IT), 인공지능(AI) 등과 같은 과학기술의 발달은 인간의 삶을 통째로 바꿔놓고 있는데, 그 중에서도 직업이 특히 그러하다. 기존의 직업들이 내용적으로 분화하여 새로운 형태의 직업이 출현하고, 이전에는 존재하지 않던 전혀 새로운 형태의 직업들이 생겨나고 있다. 이처럼 현대사회에서 사람의 직업환경의 변화는 종래의 직업적 가치관에 대한 판단기준과 직업활동에 대한 관념들을 약화시키고 있다. 무엇보다 직업활동을 하는데 있어서 도덕적 관념이나, 윤리의식이 무시되거나 간과하는 경향이 보편화되고 있다.

선원이라는 직업은 그들이 수행하는 직무활동이 어떻게 수행되는가에 따라 사회적으로 큰 영향을 미치는 분야 중의 하나이다. 선박이 위험에 처하면 선원들이 그들의 직무활동을 어떻게 수행하는가에 따라 피해의 규모가 결정된다. 그렇게 때문에 선원의 직업윤리는 사회적으로 대단히 중요한 의미를 갖는다. 2014년 4월 16일 세월호 침몰사고에서 당시 선박에는 15명의 선원이 승무하고 있었지만, 구조조치 없이 승객을 두고 선박을 탈출한 선장을 비롯한 선원들의 직무해태는 그들의 법적 책임이 어떠한가를 논하기 이전에 직업윤리 부재의 심각성을 확인할 수 있었다.

선원의 직업윤리는 선원의 직무수행에 관한 법규범적 한계를 보완할 수 있는 중요한 행동규범이 될 수 있다. 따라서 이 논문에서는 직업과 선원의 직업윤리 성질을 검토하고, 선원법과 선박직원법 등 선원 관련 법률에서 규정하는 선원의 직무내용을 분석하였으며, 선원 직업윤리의 법리적 기초를 분석하였다. 이를 바탕으로 선원의 직업윤리 강화를 위하여 선원법 등에서 선원 직무 구체화, 선원 중 직업윤리가 특히 강조되는 선박직원에 대하여 그 전제가 되는 해기사 면허취득과정에서 선원의 윤리관 평가반영, 직업윤리를 선원의 행위규범으로 객관화함으로써 선원 직무와 법제도의 합치성 제고 필요성, 그리고 선원의 직업적 만족과 자긍심을 위한 정당한 대가지급 등 처우개선의 필요성 등을 제안하였다.

The most striking feature of modern society is the development of scientific civilization. The development of science and technology such as information and communication technology(IT) and artificial intelligence(AI) is changing all areas of human life. Among these changes, there are many changes, especially in the professional field. Existing occupations are divided into content, and new types of occupations are emerging. And completely new types of jobs that did not exist before are emerging. As such, changes in human work environment in modern society are weakening the conventional judgment standards for professional values ​​and ideas about professional activities. As a result, people tend to ignore or overlook moral ideas or ethical consciousness in their professional activities. The occupation of seafarer is one of the fields that have a great social impact depending on how their job activities are performed.

It is very important for a ship to sail safely with what kind of mindset a sailor carries out his duties assigned to him. Seafarer's professional ethics can be an important code of conduct that can supplement the legal and normative limitations of seafarers' job performance.

Therefore, in this thesis, the nature of occupation and occupational ethics of seafarers was reviewed. And the duties of seafarers according to the ship organization were examined, focusing on the ｢SEAFARERS’ ACT｣& ｢SHIP PERSONNEL ACT｣, and the legal basis of seafarer occupational ethics was analyzed. Lastly, several measures were proposed to strengthen the occupational ethics of seafarers.
