초록보기

인간에 의한 지구환경의 변화는 생태위기라는 말에서 나타나듯 자연과 인간에게 위험한 정도에 이르게 되었다. 헌법상 환경권과 환경국가원리는 자연과 인간의 이익, 미래세대의 환경이익 사이의 조화를 규율하는 환경법체계의 헌법적 근거가 된다. 자연환경보전법은 자연의 구조와 기능이 훼손되지 않게 보호하고, 훼손된 자연을 복원하여 환경권의 내용이 구체적으로 실현되도록 한다. 기후변화와 생물다양성의 상실이 실생활에서 뚜렷해지는 가운데 전세계적으로 복원의 의미와 중요성이 커지고 있다. 자연환경보전법은 2021년 개정을 통해 자연환경복원사업을 규정하여 복원사업을 통합적으로 체계화하고, 생태적 가치과 기능회복이라는 원래의 목표대로 복원사업이 진행되도록 대상지역 후보지 목록 작성을 의무화하였다. 여기에서는 자연환경보전법과 복원의 의미를 헌법적으로 고찰하고, 개정된 내용의 의미와 개선점을 살펴보록 한다.
