본 연구는 최근 제정된 국내입양제도와 보호출산제도 사이에서 아동 인권의 사각 지대를 살펴보려는 목적으로 수행하였다. 이를 위해 「국내입양에 관한 특별법」과 「위기 임신 및 보호출산 지원과 아동 보호에 관한 특별법」을 중심으로 상충하는 조항을 분석하였다. 또한, UN아동권리협약과 대안양육지침 등 국제인권조약을 기준으로 아동 권리 침해 사항을 검토하였다. 두 법은 법의 목적과 국가의 책무, 양자가 될 아동의 결정, 출생신고 의무 및 입양에 대한 친생부모의 동의, 결연, 입양 철회, 입양 곤란 아동에 대한 보호조치, 입양 정보의 공개 등에서 아동 인권을 침해할 수 있는 요소를 발견할 수 있었다. 이를 토대로 연구자는 두 제도의 윤리적 쟁점을 살펴보고 법적, 실천적 제안을 하였다.

This study aims to explore the human rights blind spots for children within the recently enacted ‘domestic adoption system’ and ‘Anonymous birth system’ in South Korea. To this end, the research focuses on analyzing conflicting provisions in the "Special Act on Domestic Adoption" and the "Special Act on Support for Crisis Pregnancy, Protected Birth, and Child Protection," both established in 2023. Additionally, the study examines potential infringements on children's rights based on international human rights treaties such as the “UN Convention on the Rights of the Child” and the “Guidelines for the Alternative Care of Children”. The analysis identified several elements in the two laws that could potentially violate children's rights, including the purpose of the laws, the responsibilities of the state, the decision-making process for children to be adopted, birth registration obligations, the consent of biological parents for adoption, matching processes, the revocation of adoption, protective measures for children difficult to adopt, and the disclosure of adoption information. Based on this, the researcher examined the ethical issues of the two systems and provided legal and practical recommendations.
