주요 선진국들 중에서 먼저 미국과 영국은 우리나라의 주민등록증처럼 국가가 강제로 발급하는 국가신분증 자체가 없으며, 자율적으로 발급하는 사회보장카드나 여권 또는 운전면허증 등으로 개인의 신원을 확인 또는 증명하며, 이러한 사회보장카드나 여권 또는 운전면허증의 내부에 지문을 수록하거나 기재하지 않아서, 우리나라보다 헌법상 개인정보자기결정권을 좀 더 크고 강하게 보호해 주고 있다. 그리고 주요 선진국들 중에서 독일과 프랑스는 우리나라의 주민등록증처럼 강제적으로 전자신분증을 발급하고 있지만, 지문을 우리나라와는 달리 전자적 IC칩 안에 자율적 또는 의무적으로 수록시켜 놓고 필요시 공인된 리더기나 판독기로 인식할 수 있도록 해서, 우리나라 주민등록증의 겉 표면에 ‘지문’이 쉽게 타인에게 노출되어 각종 범죄에 악용되지 않도록 해 주어, 헌법상 개인정보자기결정권을 우리나라보다 좀 더 크고 강하게 보호해 주고 있다. 또한 일본의 마이 넘버 카드에서는 우리나라와는 달리, 일본의 마이 넘버 카드의 겉 표면 및 전자적 IC칩 안에 지문을 수록시키고 있지 않아서, 헌법상 개인정보자기결정권을 우리나라보다 좀 더 크고 강하게 보호해 주고 있다.

생각건대, 우리나라의 주민등록법령상 열 손가락의 지문 날인에 대하여, 지문은 개인의 고유성과 동일성을 나타내는 생체정보로서 개인이 임의로 변경할 수 없는 정보라는 점에서, 개인정보의 보호 상 본질적이고 근본적인 사항에 해당한다. 따라서 향후 우리나라의 주민등록법 제24조 제2항에서 개인의 열 손가락에 대한 평면 지문과 회전 지문의 사항을 명시적으로 모법에 규정하는 것으로 개정하는 것이 헌법상 ‘법률유보의 원칙’상 타당하다.

그리고 향후 주민등록법과 동법 시행령에 각각 시장ㆍ군수ㆍ구청장으로 하여금 주민등록증 발급신청서를 해당자의 주민등록지를 관할하는 경찰서의 지구대장 또는 파출소장에게 보내도록 규정한 주민등록법 시행규칙 제8조에 대한 명시적인 근거 규정을 적절히 신설하는 것이 타당하다.

또한 향후 주민등록법 제24조 제2항 본문에 규정되어 있는 ‘지문’이라는 문구를 예를 들면, 주민등록법의 입법 목적에 부합하는 ‘필요 최소한의 범위 내의 지문’ 또는 ‘모든 손가락의 지문’ 등으로 명확하게 해당 지문의 범위나 개수에 대하여 밝혀주는 입법적 개선을 하는 것이 헌법상 ‘법률유보의 원칙’ 및 ‘과잉금지의 원칙’상 타당하다.

Among the major advanced countries, the United States and the United Kingdom do not have national identification cards that are forcibly issued by the state, such as Korea’s resident registration cards, passports, or driver’s licenses, and do not contain or write fingerprints inside these social security cards, passports, or driver’s licenses, protecting or guaranteeing the right to self-determination of personal information under the constitution more than in Korea. Among major advanced countries, Germany and France forcibly issue electronic identification cards like Korea’s resident registration cards, but unlike Korea, fingerprints are autonomously or compulsorily included in electronic IC chips and recognized as authorized readers or readers if necessary, preventing “fingerprints” from being easily exposed to others and abused for various crimes, protecting or guaranteeing the right to self-determination of personal information under the constitution more than in Korea. Unlike Korea, Japan’s My Number Card does not contain fingerprints on the surface of Japan’s My Number Card and in electronic IC chips, so the constitution protects or guarantees the right to self-determination of personal information more than Korea.

I think the fingerprint seal of ten fingers in Korea’s resident registration law and enforcement decree is essential and fundamental in the protection of personal information in that fingerprints are biometric information that indicates individuals’ uniqueness and identity and cannot be changed arbitrarily. In the future, it is reasonable in light of the constitutional principle of legal reservation to explicitly stipulate matters of flat and rotating fingerprints for individuals’ ten fingers in Article 24 (2) of the Resident Registration Act in Korea.

In the future, it is reasonable to establish an explicit basis for Article 8 of the Enforcement Rules of the Resident Registration Act, which stipulates that the Mayor, the Gun, and the head of the Gu should send an application for issuance of a resident registration card to the district leader or the police chief of the police station in charge of the relevant person’s resident registration site.

In light of the constitutional principle of legal saving and principle of balancing test, it is reasonable to make a legislative improvement that clearly reveals the scope or number of fingerprints, for example, “fingerprints within the minimum necessary” or “fingerprints of all fingers” stipulated in the main text of Article 24 (2) of the Resident Registration Act.
