This study analyzed the process of enacting the law 'Yoon, Chang-Ho', which is related to punishment for DUI: Driving Under Influence, to find a way for public institution to be 'a Policy entrepreneur'. To conduct this study, we checked out the laws and policies concerned DUI in Korea through Kindon's Multiple Stream Framework(MSF)
On the policy problem stream, For decades, there have been many car crashes influenced by alcohol and also it have caused serious problems such as casualties, social costs, and reward for bereaved family. Every year in Korea, almost 300 have been killed in average. Regarding the political stream, there were many legislations to prohibit or restraint DUI during 12 years. Many people, such as politicians, members of social interest group, or the bereaved, tried to stop DUI and crashes, by proposing legislations, conducting policies, or even advertising campaigns. However, these efforts couldn't result in the powerful law or policies to restrain drunk driving.
In this situation, a man was dead by a car crash in Busan. The driver's BAC was 0.181% and got arrested for drunk driving. the man who was dead by this accident could be one of common and unfortunate victims by drunk driving accident. However, his death made a huge wave. The friends of him started to find a way to make a new law to stop DUI. Their effort led politicians to make the law named 'Yoon, Chang-Ho', who was the victim of this car crash. It showed that an unexpected or accidental happening and a constant opinion leading can make a big change in national policy.
The process of making the law 'Yoon, Chang-Ho' showed that even ordinary people can affect 'politics streams', and open 'the window of policy', if he or she was not a member of congress or politician. As a public institutions and trasnportation specialist, Korea Road Traffic Authority(KoRoad) has three advantages to be 'a policy leader'; organized statistics, traffic broadcasting system, and specialized laboratory. By using these resources, KoRoad can lead the traffic safety policy in Korea as a policy entrepreneur, and propose proper policy alternatives when 'the window of policy' open.
