이 글은 연방헌법과 주헌법에 우리 헌법 제31조 제4항과 같이 교육의 자주성?전문성?정치적 중립성을 교육의 원칙으로 보장하는 규정을 두고 있지 않은 상황에서 우리 헌법재판소와 학계의 해석론으로부터 도출되는 교육의 자주성?전문성?정치적 중립성이 내포하는 의미를 전제로 그에 상응하는 미국 교육법의 헌법적 논의를 정리하는 것이다.
개괄적인 결론은 다음 네 가지로 요약될 수 있다. 첫째, 서론에서 지적한 대로 우리 헌법 제31조 제4항에서 교육원칙으로 보장하는 교육의 자주성?전문성?정치적 중립성은 미국의 연방헌법과 각주헌법에서 명문으로 혹은 묵시적으로 인정되지 않고 있다.
둘째, 공교육에 있어서 교육전문가의 자주성보다는 교육에 대한 국가적 통제권의 우위가 확립되어 있다. 따라서 교육행정체계에서 교육전문가로서의 교원의 역할은 미미하고 우월적 지위를 보장받고 있지 않으며 단지 일반시민과 마찬가지의 지위에서 연방헌법상의 표현의 자유나 정치적 참여의 자유, 혹은 적법 절차적 보장을 향유하고 있을 뿐이다.
셋째, 국가의 공교육에 대한 강한 통제권의 헌법적 기반은 국가 및 하부교육행정기관의 민주적 정당성과 지방분권으로부터 찾는다.
넷째, 공교육에 병행하는 사립교육은 종교의 자유와 같은 교육외의 자기목적적 가치를 존중하는 취지에서 강한 자율성이 확보되며 교육의 자주성에 따른 자율성의 보장이라고 볼 수는 없다.There is no clause in American constitutions at both national and state levels equivalent to Art. 31, Sec. 4 of the Constitution of the Republic of Korea safeguarding autonomy, professionalism and political neutrality of education as a constitutional institution. The danger that state-sponsored education can establish "a despotism over the mind" is offset by two practical factors: democratic formation of state legislature and other governing bodies and local educational autonomy.
