The consideration about Prostitution Special Law
Prostitution is a reality that has existed throughout history;and throughout history, although without success, those in charge have striven to ban this reality. Although prostitution is officially criminalized in Korea, it has been alternately tolerated, permitted, regulated, or licensed in a reality. This Article stems from an interest in the recent debates over the legalization of prostitution and the draft of Prostitution Prevention Act. It starts with reviewing the ideological and feminist approaches that have developed to analyze the issues of prostitution, including the conservative moral approach, the liberal feminist approach, the socialist feminist approach, and the radical feminist approach.
The sex culture, which is very generous for men, and insensibility on distorted sexuality, with internet and information-media developing, tend to stimulate people to contact prostitution more easily. With obscene contents provided indiscriminately and easily accessed, the social pathology seems to be serious enough to collapse ethical standards.
We should be very careful when making and enforcing laws because as in some brothels cases, without any specific saving system, it could increase the number of the prostitution, which is like “effect of balloon”. So as to establish effective and efficient policies we need to find how sexual exploitation is being practiced thorough survey.
We all can’t know mental or physical anguish of people who have suffered from forced sex trade, but if we try to understand them and share the responsibility, beyond the law and system, we should try to block any route or possibility for sex crime while making various social and cultural policies.
