디지털 기술의 발달과 방송통신 융합으로 다매체 다채널 시대가 본격화되었다. 이에 따라 규제 완화를 통한 시장 경쟁 체제로의 전환이 불가피하다는 인식이 확산되고 있다. 규제 차원에서는 ‘수평적 규제체계’와 ‘매체 간 균형 발전’이 핵심적인 사안으로 부상했다. 본 논문은 이에 관련된 네 가지 쟁점을 심층 분석함으로써 지상파방송에 대한 새로운 규제방안을 탐색했다. 본 연구의 쟁점 분석 결과는 다음과 같다. 첫째, 수평적 규제체계는 기술 친화적 특성으로 인해 도입이 불가피하다. 하지만 지상파의 공공 서비스를 위해 플랫폼, 콘텐츠, 네트워크에 대한 분리 규제가 바람직하며, 규제 완화에 따른 공공 서비스 위축을 방지하기 위해 별도의 법·제도적 장치가 요구된다. 둘째, 매체 간 균형 발전을 저해하는 주범으로 지목된 지상파 독과점은 여러 측면에서 실정법상의 현상이 아니며 그 경향도 완화되고 있다. 지상파방송의 시장 우월적 지위가 비지상파 영역과 독립제작사의 비활성화 및 지역방송의 종속성을 야기한다고 단정할 근거도 미약했다. 이러한 쟁점 분석 결과에 의거해 본 논문은 현재 지상파방송에 적용되고 있는 규제를 진입 및 소유, 내용 차원으로 구분해 그 문제점을 지적하고 몇 가지 개선 방안을 제시했다.There is a wide recognition that the transition of broadcast regulation toward a market-based competition by way of deregulation is inevitable in a multi-channel environment which is grounded in digital technology and the convergence of broadcast and telecommunications. Both a horizontal regulatory framework and a balanced development of the media are the subject of many concerns. This article analyzes four issues concerning two matters in depth and explores alternative ways of broadcast regulation. The following summaries are the major findings of the study. First, a horizontal framework of regulation is unavoidable because the approach is technology-friendly. But the division into platform, content, and network areas is desirable for enhancing public broadcasting service. It is also necessary to devise a legal system in order not to encroach the public service function. Second, a monopolistic and oligopolistic phenomenon formed by over-the-air broadcasting is groundless, at least in terms of the positive law, and its symptoms gradually tend to weaken. The widespread belief of the positive relationships between the predominating status of terrestrial broadcast and the unbalanced development of the media is unfounded with regard to the growth of non-terrestrial, local broadcasting and independent production companies. Based upon the results of this study, it points out some problems of broadcast regulation by dividing its forms into entry, ownership, and content levels. Finally, the article suggests some directions and working rules for the reform of broadcast regulation.
