지상파 방송의 시대를 지나 케이블, 위성방송, DMB 등 뉴미디어에 기반한 새로운 방송 서비스 영역이 등장하고 있는 현실에도 불구하고, 방송용 콘텐츠의 질적 향상에 있어 필수 요소인 저작권 보호 규정을 담고 있는 현행 저작권법에 의하면 관련 규정이 모호하여 각종 분쟁을 예고하고 있다. 방송의 사회적 책임과 공공적 성격 역시 제대로 반영되어 있지 않으며, 저작권자, 영상제작자, 방송사업자, 저작인접권자 등 권리 주체별 영역 구분 또한 확실하지 않다.
현행 저작권법에서는 저작재산권의 하나로 방송권을 규정하고 있는 동시에 전송권도 규정하고 있다. 나아가 영상저작물의 특례 규정을 통해 영상제작자의 권리를 규정하고 있다. 최근에는 실연 또는 음반제작, 방송제작에 따른 저작인접권자의 권리 또한 더욱 확장되어 저작인접권자에게도 전송권이 부여되었지만, 이러한 규정만으로는 방송용 콘텐츠에 얽혀 있는 복잡한 저작권 문제를 해결하기에는 뭔가 여전히 부족한 실정이다. 실무적으로는 지상파방송 3사가 시장을 독과점하고 있는 상황에서 이를 해소하기 위해 외주제작 쿼터제를 시행하고 있지만, 방송사와 독립제작사 및 저작인접권자 사이의 저작권 문제가 명확하지 않은 계약 관행 때문에 불공정 상황이 심화되는 한편, 저작권 분쟁의 소지가 높아지고 있기도 하다.
이상과 같은 문제의식 아래 이 연구에서는 근본적으로 복합성을 띨 수밖에 없는 방송콘텐츠 전반을 중심으로, 저작권법에서 규정하고 있는 ‘방송’의 개념에서 오는 여러 가지 문제점에 주목하고자 한다. 나아가 이를 개선할 수 있는 방안을 제시하고자 한다. 결론적으로 디지털 시대의 방송 콘텐츠 저작권 문제에서 고려해야 할 핵심은 제작의 일선에서 일하는 사람들의 창의성을 촉진하기 위한 저작자의 권리보호와 함께 보통사람들의 공정한 이용을 통한 다양한 저작물의 원활한 유통을 도모해야 한다는 양면성을 어떻게 적절히 조화할 것이냐 하는 데 있음을 확인할 수 있었다. 전통적으로 정당성을 인정받아 온 저작권의 근본이념과 디지털 정보사회의 새로운 특성이 충돌하지 않도록 해야 하기 때문이다.Terrestrial broadcasting has been replaced with new types of broadcasting services based on new media, such as cable broadcasting, satellite broadcasting or DMB. Nonetheless, the current copyright law that deals with the protection of copyright, one of prerequisite elements for the improvement of broadcasting contents, isn’t clear enough to prevent all sorts of relevant disputes. That doesn’t reflect the social obligation and public nature of broadcasting properly, and there’s no evident definition about copyright proprietor, maker of cinematographic work, broadcasting organization and owner of neighboring rights. As the three major terrestrial broadcasting companies make a monopoly and oligopoly of the market, the quota system for alternative broadcasting is being introduced to remedy the situation, but contracts are currently made without drawing any clear-cut line among the copyright of broadcasting station, of separate production company and of the owner of neighboring rights. This phenomenon ends up solidifying unfair business practices, and there’s eventually growing room for copyright disputes.
The purpose of this study was to delve into various problems with complicated broadcasting contents, which were basically rooted in the copyright law’s concept of ‘broadcasting.’ And it’s also meant to suggest possible reform measures to improve the current practices. In a word, what should primarily be considered in the field of broadcasting contents copyright in today’s digital era is how to strike a balance between the protection of the right of author, which is important to further the creativity of producers, and a smooth, impartial circulation of works among people in general. The reason is that any possible conflicts between the basic ideals of typically justified copyright and the new features of information-oriented digital society should be eliminated.
