금융통합이 금융상품에 대한 전통적 구분을 약화시키는 가운데 본 연구는 한국보다 앞서 금융통합이 진행된 영국과 일본을 중심으로 예금보험 보호대상 지정체계에 대한 사례조사연구이다. 조사 결과 은행예금, 증권, 보험계약을 아우르는 포괄적 ‘예금’의 정의는 다른 나라에서 찾아보기 어렵고, 대부분의 국가들에서는 예금개념을 열거방식으로 규정하는 것을 확인했다. 예금보험 보호대상 판별 기준은 일본의 경우 은행예금은 결제성/이자지급/원금보장 여부가, 보험의 경우에는 기업보험여부가 보호대상 여부를 결정하는 요인이었다. 한편 영국의 경우 은행, 증권, 보험에 걸쳐 금융이용자가 개인 (및 중소기업) 인 경우를 기준으로 보호대상 여부를 결정하고 있다. 일본과 영국은 보호대상 판정이 보장기구 외부에서 이루어진다.This case research focuses on how to legally define ‘protected deposit’ in the deposit insurance scheme of major industrialized countries-in particular Japan and U.K. which underwent financial integration process ahead of Korea. The results show that comprehensive definition of “deposit”, used for all types of financial products including securities and insurance products, is not found to exist. As to classification criteria for “protection”, Japan uses payment, interest payment or principal guarantee for bank deposits and personal lines for insurance products, while U.K. has a single criteria of user basis. And determination process takes place outside the protection scheme in both countries.
