Reflection on the Work of Revising the Nationality Act in 1991-92
Current “Nationality Act” of the Republic of Korea(ROK) has come into effect since the revision in 1997. The most important purpose of the revision in 1997 was to realize the equality between men and women in the right to nationality. Until then, former Korea's Nationality Act was based on the principle of jus sanguinis patrilineal line. Before the revision in 1997, Korean Government tried to revise the Nationality Act once more in 1991-1992. The Ministry of Justice organized the Special Committee for revision and finalized the draft of new Nationality Act after one and half year's work. However, it was not even submitted to the National Assembly. This article explains the process of the 1992 Draft making and its contents, and analyzes the reason of its failure.
