정보에서 국력이 나온다. 때문에 지금 각국은 정보기관의 역량 강화에 팔을 벗고 나서고 있다. 오늘날 정보전쟁의 시대에 즈음해 국정원은 국가안보와 국익 수호를 위한 다양한 정보활동을 수행해야 하는 과제에 직면해 있다. 그러나 아직까지 국정원의 정보활동(국가정보활동)은 법적ㆍ제도적 기반이 매우 취약하여, 법 밖의 영역에 놓여 있는 곳이 적지 않다. 때문에 정치사찰, 권력남용, 인권침해 등의 시비에서 벗어나지 못하고 있다. 민주화는 국정원의 정보활동이 더 이상 베일에 가려있지 않을 것을 요구하고 있다. 국정원 활동의 법률주의, 투명성의 증대, 탈정치화ㆍ탈권력화, 국회 및 여론의 통제는 이제 불가피한 대세라고 할 수 있다. 당면하게는 국정원의 정보활동 중에서 남북회담 참여ㆍ지원, 특히 대북 비공개 접촉, 비밀공작, 정책정보활동 등에 있어 법적ㆍ제도적 기반을 구축 내지 강화하는 것이 시급하다. 더불어 국정원의 탈정치화 및 탈권력화를 제도적으로 뒷받침하기 위해 국가정보원법을 개정할 필요가 있다. 예컨대, 국내보안정보의 범주 조정, 국정원 고위간부의 전문성 및 정치적 중립성 확보를 위한 요건 강화, 불법행위의 내부고발자 보호, 전직 직원의 범죄에 대한 수사권 확보 등을 추진하는 것이 바람직하다.National power comes from information. Therefore, every country makes efforts to strengthen the capabilities of its intelligence agency. In the everyday battle for information, with the goal of ensuring national security and advancing national interests, the National Intelligence Service (NIS) of the Republic of Korea faces the task of addressing diverse intelligence requirements. However, the legal basis for the NIS's intelligence activities is fairly weak, allowing the NIS to be misappropriated for partisan political purposes and bringing about civil rights abuses. Democratization demands that the NIS's activities no longer remain hidden in the veil. Now, it is an inescapable trend that the NIS must abide by the law, increase transparency, rise above partisan politics, power struggles, and work under parliamentary control, taking public opinion into consideration.
Amongst the NIS's responsibilities include participation or assistance in North-South talks, clandestine contacts with North Korean agents, North Korea secret intelligence operation, policy intelligence activities. There needs to be legal foundation or rationale for those activities. Furthermore, there is a need to revise the National Intelligence Service Act. For instance, it is quite necessary to clearly establish limits on the range of domestic intelligence activities, to make a rule for high-ranking NIS officials to separate their partisan beliefs from their professional duties, to institutionalize a mechanism for allowing NIS whistleblowers and employees to grieve against the unlawful superior order, and to formulate a process for allowing the investigation of former NIS employees' crimes.
