본 연구에서는 동영상 UCC 제공 서비스의 확산으로 방송콘텐츠 및 여타콘텐츠의 저작권 침해가 심각하게 발생하는 현상에 주목하고, 방송사의 저작권과 수익을 보호하면서도 동영상 UCC 유통 비즈니스모델이 유지 가능한 방안을 모색해보았다. 국내에서 이미 성장단계에 있던 동영상 UCC 제공 서비스모델은 ‘유튜브’의 성공사례로 더욱 주목을 받게 되면서, 전문 사이트나 포털 영역 모두에서 서비스를 강화하고 다수의 네티즌이 동영상 UCC의 제작과 이용에 참여하게 되었다. 그러나 동영상 UCC는 전문적인 콘텐츠 제작자가 제작하는 콘텐츠가 아니기 때문에 저작권 침해, 음란물 유포, 명예훼손 등의 구조적 문제를 안고 있고 이에 대한 규제 논의가 활발하다. 따라서 방송사를 비롯한 저작권자와 동영상 UCC 사업자 간의 소송이 이어지고 있고, 현행 저작권법 하에서 기존 방송콘텐츠 및 여타콘텐츠를 무단 복제하는 방식의 동영상 UCC 제작과 이를 기반으로 한 비즈니스모델 운영은 불법이며, 현재와 같은 운영시스템의 유지는 어렵다. 하지만 동영상 UCC가 텍스트 UCC와 같이 사회적 여론 형성과 개인적 표현의 활성화에 기여할 수 있는 가능성이 있고, 인터넷 문화의 상징인 웹2.0 패러다임에 부합되기 때문에, 단순히 불법성만을 근거로 관련 산업이나 네티즌의 문화를 약화시키기는 어렵다. 따라서 본 연구에서는 저작권법 개정 이전에 저작권집중 관리단체와 정부지원기구를 통한 저작권 데이터베이스 구축과 싸이월드식 아이템 판매시스템 도입, 방송사와 동영상 텍스트 UCC 간 공동의 비즈니스모델을 제안하였다.This study explored possible plans to protect broadcasting stations' copyrights and eamings as well as to preserve business models of video UCC circulation, while paying attention to a phenomenon that the copyright infringement of broadcast contents and other contents happens severely through the diffusion of video UCC service. Business models for video UCC service provider which already have been at the stage of growth in Korea attracted more public attention due to a remarkable success story of ‘YouTube.’ As the field of professional sites and portals strengthened its service, majority of netizens have participated in creating and using video clips for UCC. However, video UCC is not produced by professional contents creators, so it has caused lively debates on regulation since video UCC has structural issues such as copyright infringement, pornography dissemination, defamation of character and so on. Therefore lawsuits between copyright owners including broadcasting stations and video UCC industry continue to proliferate because the way of vido UCC production by unauthorized copying and operation of business model based on that are considered illegal. However video UCC and text UCC could not be weakened on the ground of the simple illegality since they could not only contribute to activate social public opinions shaping and personal expression, but correspond with the Web 2.0 paradigm which is a symbol of Internet culture. Therefore this study suggested building a copyright database by a body of intensive copyright management and a supporting branch of government, introducing an item selling system like Cyworld, and a business model cooperated by broadcasting station and video UCC industry.
