2008년 4월 18일 합의된 한미간의 쇠고기수입 합의문서를 둘러싸고 우리나라에서는 많은 논쟁이 계속되었고 현재 이 합의문서의 위헌여부를 헌법재판소에서 심리 중에 있다. 이와 관련하여 이 합의문서의 국제법적 지위와 국내법적 지위에 대한 학문적 검토도 필요하다고 생각된다.
1969년 조약법에 관한 비엔나협약 제2조 1항 (a)호는 “ ‘조약’이라 함은 단일의 문서에 또는 2 또는 그 이상의 관련문서에 구현되고 있는가에 관계없이 또한 그 특정의 명칭에 관계없이, 서면형식으로 국가 간에 체결되며 또한 국제법에 의하여 규율되는 국제적 합의를 의미한다”고 “조약”을 정의하고 있다. 즉, 국제법상 “조약”(treaty)은 그 명칭에 관계없이 서면형식으로 국가간에 체결되며 법적 효력이 있는 국제적 합의를 의미한다.
한미 쇠고기 수입합의는 한미 양국간에 법적 효력을 가진 국제법상의 조약으로 보인다. 그럼에도 불구하고 그 체결절차는 우리나라의 헌법이 규정하고 있는 조약의 체결절차를 거치지 않아 “헌법에 의하여 체결ㆍ공포된 조약”이라고 보기 어렵다.
한미 수입합의는 약식조약으로 볼 수 없고, 고시류조약이나, 기관간 약정이라고 보기도 어렵다. 따라서, 이번 합의는 헌법 제6조 1항의 공포요건의 결여로 인한 제6조 1항의 위반, 국무회의 심의의 결여로 인한 헌법 제89조의 위반, 국회의 체결ㆍ비준 동의의 결여로 인한 헌법 제60조 1항의 위반이라는 문제점을 가지고 있다고 하여야 할 것이다. 결론적으로 한미 쇠고기 수입합의는 우리나라의 헌법에 위반한 조약으로서 우리나라의 국내법과 같은 효력이 없다고 판단된다.Agreed Minutes of the Korea ? United States Consultation on Beef and Import Health Requirements for U.S. Beef and Beef Products (Korea-US Beef Agreement) which were initialed by representatives of South Korea and the United States on April 18, 2008 are now subject to fierce controversies including the judicial scrutiny of the Korean Constitutional Court in South Korea. In this article, the author reviewed the legal status of the Korea-US beef agreement both under international law and Korean domestic law.
Article 2 (1)(a) of the 1969 Vienna Convention on the Law of Treaties defines a “treaty” as: “an international agreement concluded between States in written form and governed by international law, whether embodied in a single instrument or in two or more related instruments and whatever its particular designation”.
The author considers the Korea-US beef agreement as a treaty between Korea and the United States. However, the agreement is in violation of the Korean Constitution and cannot have the same legal effect as Korean domestic laws since Article 6(1) of the Korean Constitution provides “Treaties duly concluded and promulgated under the Constitution and generally recognized rules of international law shall have the same force and effect of law as domestic laws of the Republic of Korea.”
The author argues that only “treaties duly concluded and promulgated under the Constitution” have domestic legal effects and that the Korea-US beef agreement is not the treaty duly concluded and promulgated under the Korean Constitution. He pointed out the Korea-US beef agreement violated the following provisions of the Korean Constitution: Article 6 (1) (this paragraph requires the promulgation of a treaty, but the Korea-US agreement was not promulgated); Article 60(1) (this paragraph requires the conclusion and ratification of some important treaties should be consented by the Korean National Assembly, but the conclusion of the Korea-US agreement was not consented by the Korean National Assembly); Article 89 (this article requires “proposed treaties” should be referred to the State Council for deliberation, but the Korea-US agreement was not).
