국제법상 법의 일반원칙은 국제사법재판소규정(ICJ) 제38조 1항에 의해 국제법의 법원으로서 인정되고 있다. 즉, 조약과 국제관습법에 이어 국제법의 세 번째 법원으로서 국제사법재판소규정 제38조 1항은 “문명국이 인정한 법의 일반원칙”을 규정하고 있다. 그러나, 국제관습법의 경우와 마찬가지로 무엇이 법의 일반원칙인지를 명확히 정의한 조약이나 국제적 문서는 존재하지 않는다. 따라서, 무엇이 법의 일반원칙인지에 대하여 학자간에 여러 의견이 제기되고 학설의 대립이 있어왔다.
이 글에서는 법의 일반원칙에 해당하는 규칙의 분류, 법의 일반원칙의 법원성, 법의 일반원칙의 적용순위와 적용사례, 법의 일반원칙과 형평과 선의 관계에 대해 살펴보고자 한다.
특히 형평과 선과 법의 일반원칙과의 관계는 상당히 모호한 측면이 존재하며 이에 대해서 필자는 형평과 선은 법의 일반원칙으로 인정되지 않은 자연적 정의(natural justice)나 자연법을 의미하는 것이며, 법의 일반원칙과 달리 그 자체가 국제법의 법원은 아니라고 생각한다.
법의 일반원칙은 국제소송을 수행함에 있어서 조약, 국제관습법과 함께 매우 중요한 역할을 할 수 있다는 점을 유념하여 법의 일반원칙을 발견하고 원용하는 노력을 계속하여야 할 것으로 판단된다.International law, general principle of law (GPL) is a source of international law under Article 38 (1) of the Statute of the International Court of Justice (ICJ). In addition to treaty and customary international law, Article 38 (1) of the ICJ Statute provides “general principles of law recognized by civilized nations” as a third source of international law. However, like customary international law, there is no treaty or other instrument that clearly spells out what is meant by general principle of law. So, scholars and writers have suggested various theories on the meaning of GPL.
This article deals with categories of GPL, legal nature of GPL, international decisions which applied GPL to the cases, the relationship between equity and GPL.
In particular, the relationship between equity and GPL has some vagueness and ambiguities. I think equity is derived from natural justice or natural law, but is not considered as GPL by the international courts. Thus, equity itself is not a source of international law whereas GPL is a source of international law.
Finding and applying GPL is necessary because GPL may play a very important role together with treaty and customary international law in conducting international litigations.
