한 사회가 아동을 어떻게 이해하고 대우하는 가에 따라서 아동의 지위는 달라진다. 우리 사회는 그동안 아동을 ‘부모의 소유물’로서 이해하는 가족의 신성성을 중요시 하는 가치관을 유지해 왔다. 이와 같은 가치관은 아동을 개별적 욕구를 갖고 있는 인격적 존재로 이해하지 못할 뿐만 아니라, 자발적 의사표현이 가능한 존재로 이해하지도 못함을 의미한다. 동일한 위험에서도 아동은 성인과는 다르게 영향을 받고, 아동은 성인에게 부여된 것과 같은 인권을 갖지만 아동기의 발달에 대한 방해는 성인보다는 아동에게 훨씬 더 심각한 영향을 준다. 아동에게는 다른 유형의 인권보호가 필요하다. 그 대표적인 대상으로서는 신생아 가운데 조산아, 특별히 중증장애가 예상되는 미숙아들이 부딪치는 위험은 더욱 심각하다. 현대 사회에서 의학의 기술발전으로 인해 과거 같으면 생존이 불가능한 신생아들의 생명을 구하는 일과 이들의 생명연장에 관한 윤리적인 실천에 관해 살펴보는 것이 필요하다.In this article have attempted to clarify complex arguments about a very emotive and painful issue in contemporary society. Ironically, both who oppose and those who advocate prenatal diagnosis or the treatment for the severely disabled and impaired infants can make the mistake of exaggerating the potential of screening to detect and eliminate disabled children. Genetic intervention is not the solution to the disability problem, nor is it a significant threat to disabled people. Therefore, while interesting dilemmas are raised, in terms of disability rights this option seems less problematic than existing prenatal diagnosis and the treatment for the severely impaired disabled infants. It conclude that however, the privacy of those faced with these difficult decisions should be respected, and their autonomy supported. Everyone has an interest in helping prospective parents make better decisions, which they are less likely to regret at a future date. We should be on hand to offer counselling, good quality information and support, but we should not venture to dictate where the duties of prospective parents may lie.
