2000년에 개정한 대한민국의 변호사법은 변호사의 공익 활동을 의무화하였다. 연간 일정 시간 이상의 공익 활동을 수행하지 않으면 징계할 수 있도록 하였다. 이런 이례적 입법과 함께 오래된 물음이 다시 제기되었다. 변호사 공익 활동의 근거는 무엇인가? 어떠한 것이 변호사의 공익 활동인가?
변호사 공익 활동 의무의 근거를 세 가지로 나누어 밝혔다. 역사적 이유, 사회경제적 이유 그리고 이론상 이유를 제시하였다. 그러나 변호사 공익 활동은 이론적이라기보다는 실천적인 과제다. 무엇을 공익 활동이라고 할 것이냐라는 문제에 너무 집착할 필요는 없다. 어떤 프로그램이든지, 고유한 의미의 공익 활동이라 할 수 있는 프로보노를 기초로 하여 창조적이고 개성적인 공익 활동 영역을 개발하여야 한다.
속성상 상업적인 변호사란 직업에서 공익성을 필연적으로 도출해낼 수 있다는 사실을, 법률가들은 다행스럽고 자랑스럽게 생각해야 할 것이다.The Attorney-at-Law Act as amended in 2000 provides that every attorney-at-law should perform public interest activities and anyone that engages in such activities for less than a certain number of hours shall be disciplined.
Upon the codification of such unusual requirement, a long-standing question is once again raised: what is the basis of attorneys’ obligation for public interest activities and what constitutes such activities?
This study examines the basis of attorneys’ obligation for public interest activities in three aspects ? historical, socioeconomic and theoretical.
Nonetheless, attorneys’ obligation in this area is a matter of implementation, not of theoretical debates. There is no need to focus disproportionately on how public interest activities can and must be defined. We should explore and design creative and innovative programs for public interest, whichever form it takes, based on pro bono that is a fundamental aspect of public interest activities.
We are privileged in that our profession, which is commercial in nature, is also destined to seek public interest, and should take pride in serving in this capacity.
