본 연구는 국회 위원회제도의 기원과 변천을 국회사적 맥락에서 분석함으로써, 현형 제도들을 만들고 지속시켜 왔던 원리와 경험적 근거를 밝혀 현행제도를 재평가할 기초를 마련하는데 주요한 목적이 있으며, 위원회 제도가 갖는 전문성과 대표성 실현 제도로서 법제사법위원회제도, 상임위원회 위원 2년 개선제도와 겸직제도에 주목한다. 제도의 기원을 밝히기 위해 연구는 제헌의회와 2대국회 회의록을 중심으로 역대국회 사료들을 분석하였다.
분석결과 법제사법위원회의 ‘체계·자구심사’기능이 위원회 분업구조에 반영된 것은 1951년 제2차 「국회법」개정에서였지만 당대의원들은 이 기능이 일반상임위원회 업무의 지원기능 정도로 인식하고 있었고 개정안 역시 법사위의 ‘체계, 형식’심의 후 소관위원회로 이송하도록 되어 있었다. 법사위가 다른 모든 위원회에 대한 별도의 분업구조로 자리잡은 것은 1960년의 개정과정에서였다.
한편 제헌의회 및 2대 국회에서 상임위원회 위원 개선제도가 도입된 배경에는 의장-위원장-위원회 위원이라는 의회의 의사결정 위계구조에 대한 국회의원들의 ‘평등주의’적 인식이 자리잡고 있음을 확인할 수 있었다. 불가피하게 초선의원이 압도적이었던 당시 상황에서, 제도를 결정했던 의원들은 위 직위를 의회운영에 필요한 위계구조이자 전문성 축적구조로 이해한 것이 아니라 ‘평등’한 의원들 간의 ‘민주적 훈련’의 기회로 인식했고, 권력독점에 대한 견제장치로서 임기 중 개선을 통해 순환하는 것이 바람직하다고 인식하고 있었다. 민주화 이후 20여년이 지났음에도 의원 임기 중 의장-위원장-위원 개선제도가 유지되고 있는 이유는 제도가 채택되던 당시와 크게 차이가 없다. 초선의원 교체율이 평균 50%를 상회하는 조건에서 여전히 권위와 전문성 확립이라는 관점보다는 평등주의와 독점견제라는 접근이 더 우세한 것으로 보인다.The subject of this study is to analysis the origin of Korea National Assembly committee system. This study focus on the relation of the legislation & judiciary committee and the other committees and the re-election system of the standing committee members in the midst of the electoral term.
The division system of the legislation & judiciary committee and the other committees has originated from the 2nd National Assembly. But in the 2nd National Assembly, the legislation & judiciary committee only assisted the other committees and the jurisdiction committees took the responsibility for the all process of the bills' deliberations. In the 9th amendment of 1960, the compulsory second step deliberation of the legislation & judiciary committee was introduced.
On the other hand, the re-election system of the standing committee members in the midst of the electoral term was introduced in the 4th amendment process of 1953, and the re-election system of the committee chairmen had introduced in the 1st National Assembly. The Congressmen at that times had preferred the rotation system of the chairmen and the ordinary members of committees, furthermore the President. Because the absolute majority of them was the newly-elected members, they were sharing the sentiment of the egalitarianism.
