국가보안법은 1948년 12월 1일 제정된 이래 대한민국의 자유민주체제를 전복?파괴하려는 북한의 대남혁명전략에 효과적으로 대응하여 온 방어적?자위적 성격의 안보 관련 특별형사법이다. 이 국가보안법의 중심개념은 반국가단체라는 것이다. 하지만 그동안 반국가단체의 개념과 적용범위가 반드시 분명치 않아 시민사회에서 논쟁과 오해를 불러일으키기도 했다. 북한의 유엔 가입과 남북기본합의서 채택 후 반국가단체 개념은 더 이상 타당할 수 없다는 주장도 제기된 바 있었다. 그러므로 대법원 판례와 헌법재판소 결정을 통해 확립된 반국가단체의 개념과 적용범위를 확정하는 일은 부당한 기본권 침해 방지는 물론 질서 있는 남북관계 운영을 위해서도 매우 중요하다. 나아가 중?장기적으로는 반국가단체의 정의규정을 수정하는 방안도 신중하게 검토할 필요가 있다.The National Security Law of the ROK is special criminal law which is self-defensive and has been operating effectively against the revolutionary strategy of North Korea since it was enacted in December 1st of 1948. The core concept of the National Security Law is an “anti-state organization.” However the definition and scope of anti-state organization in real application may not have been clear enough. Public opinions are sharply divided with some misunderstandings on the issue of legal propriety of the law among scholars and civil society as well.
It has been argued that the concept of the anti-state organization is not acceptable anymore after the North Korea joined the United Nations and the Inter-Korean Basic Agreement was concluded between the South and the North in 1991 in particular.
Therefore, it is important that we should delimit the concept and scope of the anti-state organization by referring to judicial decisions or precedents of Supreme Court’s and the Constitutional Court. Meanwhile such a theoretical work could not only contribute to protecting fundamental human rights of citizens and but also be able to establish the orderly and stable Inter-Korean relationship. In addition, we should prudently consider revising the clause relating to anti-state organization as a long-term plan.
