알코올은 범죄 및 형사정책에 영향을 미치는 중요한 요인임에도 불고하고, 알코올과 범
죄행위 및 형사정책에 대한 연구들은 활발하기 않은 편이다. 이 연구에서는 범죄행위에 영
향을 미치는 알코올의 역할과 우리 사회에 나타난 알코올관련범죄를 살펴보고, 그에 대한
국가의 형사정책적 대응방안에 대하여 논의하고자 한다. 이러한 연구를 통하여 우리 사회
에서 알코올과 범죄간의 관계를 이해하고, 이에 대한 적절한 형사정책적 대응방안을 모색
하려는 것이다.
우리의 음주문화는 음주 및 음주로 인한 문제행동 등에 대하여 관대한 양상을 보이며,
이러한 음주에 대한 관용적 문화는 알코올-관련범죄에 대한 국가정책 및 형사사법체계에도
영향을 미치는 것으로 보여진다. 국가의 공식통계자료에 나타난 우리 사회에서 알코올-관련
범죄의 경우, 알코올은 손괴 및 방화 등의 파괴성 범죄와 폭행 및 성폭력 등의 폭력범죄와
강한 관계를 보이는 것으로 나타났다. 가정폭력의 경우에도 알코올은 강한 영향을 미치는
것으로 나타났다. 또한 약물정책으로서 알코올에 대한 국가정책은 자율적 또는 방임적 양
상을 보이며, 형사정책적 측면에서도 음주는 형의 선고에서 감경사유로 적용되는 등의 관
용적 양상을 띠었다. 그에 비하여 음주운전 및 음주운전으로 인한 교통사고의 경우에는 예
외적으로 중형주의적 입장을 위하는 것으로 나타났다.
비록 최근에 음주에 대한 관용적인 형사정책적 대응에 대한 비판과 반성이 이루어지고
있지만, 아직도 음주 및 음주문제에 대한 사회적, 국가적, 그리고 학문적 관심과 연구는 미
흡한 수준이라고 할 수 있다. 앞으로 이러한 영역에 대한 좀 더 심도 있고 체계적인 연구
및 논의가 요구된다.The purpose of this study is to review and examine on relationship of alcohol, crime, and
criminal justice in Korea. Generally, it is believed that alcohol use/abuse leads to crime, such as
disorder, violent and property crime. A number of theory have been proposed to explain the
link between alcohol use and violent or property crime. These theories are pharmacological
effect, endocrinological, neurobiologic, environmental, economic, social and cultural determinants.
This perception is supported and fostered by theoretical and empirical research from many
different disciplines showing a positive association between alcohol use/abuse and crime. In
Korea, there is a strong relationship between alcohol use and violent crime by national crime
statistic and self-reported survey. 35)
In many theoretical and empirical research, there is a strong association between alcohol use
and crime. But it may not be useful in guiding public policy and criminal justice policy
designed to reduce and prevent crime. Therefore this paper try to review and estimate on the
existing policy of drug and alcohol-related crime in Korea, and introduce the alternative
perspective on alcohol-related crime, such as drunk-driver and drunk-sexual violence. From our
study, it is implied that future research should attempt to develop a more refined model on the
relationship between alcohol and crime.
