의료행위 과정에서 의료진의 조치에 어떠한 잘못이 있더라도 환자에게 발생한 나쁜 결과와 사이에 상당인과관계가 인정되지 않으면 환자로서는 그 나쁜 결과로 인한 손해의 배상을 구할 수 없다.
그런데 평석 대상인 대법원 2006. 9. 28. 선고 2004다61402 판결은 전신마취에 따른 충수돌기염 수술을 받은 환자가 통상의 마취 회복 기간이 경과하도록 정상적인 의식상태로 돌아오지 못한 채 소뇌동정맥 기형이라는 특이체질로 인한 뇌출혈로 사망한 사안에서, 수술 후 경과관찰 등 사후 관리를 소홀히 한 의료진의 불법행위책임 여부가 다투어지자 “의료행위상 주의의무 위반과 악결과 사이에 상당인과관계가 인정되지 않더라도 그 주의의무의 위반 정도가 일반인의 처지에서 보아 수인한도를 넘어설 만큼 현저하게 불성실한 진료에 해당하면 그 자체로서 불법행위를 구성하여 환자 본인 및 그 가족이 위자료의 배상을 구할 수 있다”고 판시하였다. 이는 의료상 과실과 나쁜 결과 사이에 인과관계가 입증되지 않는 경우에도 의료상 주의의무의 이행 태양과 그 위반 정도를 살펴 의사 측의 배상책임을 인정할 수 있는 요건과 범위를 적극적으로 제시한 최초의 대법원 판결로서 그 의미가 자못 크다.
이 글에서는 의료상 과실에도 불구하고 환자에게 발생한 나쁜 결과와의 인과관계가 인정되지 않는 경우에 의료진의 배상책임이 성립할 수 있는 근거와 함께 그 구체적인 요건과 책임범위를 살펴봄으로써 위 판결의 의미와 향후 의료과오소송에 미칠 영향을 검토하고 있다.Even proving the breach of duty of standard care on the part of the defendant, physicians or other health-care providers, a plaintiff can not recover damages for medical malpractice resulting in injuries or death unless he/she establishes that the breach of duty was a proximate cause of the injury or death.
However, on Sep. 28, 2006, the Supreme Court of Korea made a decision on a medical malpractice case where, after the defendant performed an operation to remove the patient's appendix, the patient could not come out of the anesthesia and died of cerebral hemorrhage caused by arteriovenous malformation, a kind of diathesis, after falling unconscious while under general anesthesia. The issue for the court to decide was whether the defendant-physician or the other health care provider is liable for damages due to his negligent practice of medical care such as negligence in monitoring the patient's condition after the surgery as a negligent conduct in the postoperative care. The court made a judgment on this case that "an injured patient or surviving family can recover damages for medical malpractice resulting in injuries or death when duties of standard care were breached by physicians or the other health-care providers so grossly that an ordinary reasonable person can not endure, constituting tort per se, even there was no causation between the breach of standard care and the injuries or death."
This is the first decision of the Supreme Court providing some guidelines for elements and liability extent to make physicians or the other health-care providers be liable for the damages on the patients depending on the degree of breach of standard care even in the case where a plaintiff fails to establish the proximate causation between the breach of care and the injuries.
This article will examine legal basis and elements in detail to make physicians or the other health-care providers, who breached duties of standard care, be liable for the damages on the injured patient even without establishing causation between the breach of care and the injuries. This article will also review the effect of above Supreme Court ruling on the cases of medical malpractice hereafter.
