선거는 대의민주주의 하에서 중요한 헌법적 주제이다. 선거야말로 대의민주주의 헌법 하에서 주권자인 국민이 국가의사를 대신 의논하고 결정해 줄 대표를 뽑는 과정이기 때문이다. 세계 각국의 헌법은 이러한 선거제도에 대해 헌법에서 대강의 틀을 정하고 구체적인 내용은 보통 선거법 등 하위법률에서 이를 상세히 규정하고 있다. 그런데 이러한 선거제도가 선거부정 방지를 통한 ‘공정한 선거’를 위해 일정 유형의 선거운동은 이를 규제하는 내용을 담고 있기도 하다. 이 때 이러한 선거운동의 규제가 선거 후보자나 유권자의 입장에서는 언론?출판의 자유나 결사의 자유와 같은 표현의 자유나 평등권을 침해하는 것이 될 수 있는 것이다.
미국 연방대법원도 선거운동에 대한 어느 정도의 규제가 합헌인지에 대해 오래 전부터 수많은 판결들을 내려왔고 이를 통해 합헌적인 선거운동 규제의 내용과 범위에 대한 법리를 발달시켜 왔다. 미국 헌법과 미국 연방대법원이 제시하고 있는 이러한 합헌적인 선거운동 규제의 내용과 범위에 대해 규명해 봄으로써 우리의 선거운동 규제입법을 만드는데 타산지석으로 삼아보고자 하는 것이 본 연구의 목적이다.
이러한 목적을 이루기 위해 다음에서는 먼저 미국의 선거 관련 법체계와 선거제도에 대해 개관한 후, 선거제도와 관련된 미국 연방대법원의 주요판결들을 시대순으로 살펴본다. 그 후 이 판결들의 내용을 귀납적으로 정리하여 정치적 표현과 정치적 결사의 자유라는 관점에서 ‘정당’에 대한 규제와 ‘정치자금’에 대한 규제에 대해 미국 연방대법원이 어떤 법리를 전개시켜 왔는지를 알아본다.The election is an important constitutional issue in the representative democracy. That is because the electoral process is the very scheme by which the people select their representatives who will decide administrative polices and enact laws on behalf of them. Nearly all the countries in the world provide the frame of the election process in their Constitution while its details are prescribed in their statutes. Sometimes, the statutes regulate certain types of the election campaign to achieve the ideal of the fair election and the regulations could from time to time violate the freedom of the association and the expression of the candidates and the constituents.
The U.S. Supreme Court has issued many decisions in regards to the constitutional criteria of the regulations of the election campaign and the political money. At the same time, it has developed the constitutional principles for the contents and the boundaries of the election campaign. This paper aims at exploring the contents and the boundaries of the constitutional election process which have been developed by the U.S. Supreme Court.
To achieve the aim, this paper looks over the American legal systems on the election campaign at first, and analyzes the major decisions of the U.S. Supreme Court on the electoral process. Then, it will examine the constitutional principles that have been developed by the U.S. Supreme Court on the valid regulations of the political money and the political parties in terms of the freedom of the association and the expression by inductively generalizing the major decisions.
