1994년에 본격 도입된 우리나라의 민간투자제도는 10년 이상의 장기계약을 기초로 공공사업을 시행하는 방법으로서 단년도 위주의 행정명령 방식의 전통적 위임사업 방식과는 크게 다르다. 특히 2000년대 초반부터 민간투자사업이 활성화된 가장 중요한 이유는 최소운영수입보장, 정부지원 등 다양한 재정지원이 적극적으로 이루어졌기 때문이다. 그런데 이러한 재정지원 때문에 민간투자사업은 재정부담을 미래로 전가하는 투명하지 않은 제도라는 비판이 동시에 제기되었다. 민간투자제도가 장부 외 부채를 초래한다는 비판을 불식하기 위해서는 민간투자사업에 내재하는 각종의 위험을 분석하여 그것이 정부의 금융리스인지 여부를 판별해야 한다. 다시 말해 정부가 자금조달의 수단으로 민간투자사업을 시행하고 있다면 일종의 금융리스로서 이는 정부의 채무로 회계처리되어야 한다.
본 논문은 UN의 국민계정(SNA)지침, IMF의 재정통계지침(GFSM), 유럽연합의 재정적자와 채무지침(MGDD) 등의 내용을 조명한 후, 이들 중에서 가장 구체적인 기준을 적시하고 있는 MGDD지침을 우리나라에 적용하여 금융리스 여부를 가늠해보았다. BTL뿐만 아니라 BTO의 경우에도 최소운영수입이 보장되는 많은 사업들이 금융리스로 간주될 수 있는데, 이러한 결론은 2010년 2월 정부가 마련한 ‘민간투자사업 회계처리지침’의 개선을 요구하는 것이다.A fiscal accounting and reporting standard has not yet been developed for PPPs In Korea. International statistical and accounting guidelines, e.g., SNA(System of National Accounts), GFSM(Manual on Government Finance Statistics), MGDD(Manual on Government Deficit and Debt), tend to allocate the ownership of the PPP assets to either the public or the private partner, depending on a determination of how risks are apportioned between the two sectors. MGDD is the most specific guidelines for a fiscal accounting for PPPs, saying a private partner will be assumed to bear the balance of PPP risk if it bears most construction/performance risk or demand risk.
This paper applies Eurostat's MGDD to Korean PPPs, analyzing PPP risks in terms of the model contracts presented by PIMAC, Korean agency responsible for enhancing fiscal productivity through efficient and transparent public and private infrastructure investment management.
