As a part of defense reform, the issue of top military command restructuring has been continuously raised and accompanies some controversies, notably related to the Constitution. Some say that if the titles of the Chairman of Joint Chief of Staff(CJCS) and the Chief of Staff of Army, Navy, and Air Force, which Article 89 Clause 16 of Constitution provides, are changed or eliminated, they might breach the Constitution. However, we argue that the mentioned constitutional clause be interpreted as a reference to cautious nomination considerations in Cabinet Council. Accordingly, there is no constitutional issue even if the title of senior military positions are changed or created as long as their nominations are subject to Cabinet Council consideration. We reach similar conclusions after reviewing the past precedents of the Constitution, Government Organization Act, and National Military Organization Act.
