이 연구는 학교단위의 책임경영이 다양한 교육을 위하여 강조되고 있는 시점에서 학교운영 지원을 위해 지방교육행정기관 관계 법률을 어떻게 개정해야 하는가를 살펴본 연구이다. 이를 위해 한국의 지방교육행정체제에 관한 법적 기반 검토를 통해 그 특징을 밝히고, 이어 2010년 6월부터 정부가 본격적으로 추진한 ‘지역교육청 기능 개편 방안’과 그 추진 체제를 분석하였다. 또한 지방교육행정기관의 역할 정립의 기준 마련을 위해 주요국의 지방교육행정체제를 비교법적 관점에서 살펴봄으로써 시사점을 도출하였다.
법률 개정의 기본 방향으로 지역교육청의 관리ㆍ감독 기능의 전면 부정보다는 관련 시스템을 재정비하고 그에 상응하는 권한의 재조정, 인적ㆍ재정적 지원이 뒤따라야 한다는 합목적성, 국가 교육행정체제에 있어서 중앙과 지방교육행정기관의 역할이 재설정되면서 동시에 지역교육청과의 관계가 재설정되어야 한다는 행정의 체계성 측면을 강조하였다.
법령 개정 과제로 먼저 국가와 지방자치단체(장관과 교육감)의 역할분담 원칙, 교육장의 고유사무의 설정, 교육장의 고교분장사무 조례 제정등의 필요성 등을 제안하였다.The purpose of this study is to define how to revise laws related the local administrative agencies at the point of emphasizing the responsible school-based management for diversity education to support school-based management. For this, this paper tried to clarify the foundation of laws related to the local administrative system of education and also analyzed 'the initiatives on the revision for local district offices of education' that the Korean government has promoted since June 2010. In addition, the implication is drown by reviewing the local administrative system of developed countries including England, USA, and Japan to establish a standard for appropriate roles of the local administrative agencies of education in Korea.
The fundamental direction for the revision of the laws is presented to reorganize the system that has functions of administration and supervision in district offices of education rather than to repudiate existing functions, in accordance with the purposiveness followed by reorganizing office's authority and supporting human resources and finances. In addition to the direction, this paper examined the systematical aspects of education administration to reestablish roles of central and local administrative agencies of education in terms of national administrative system of education fundamental direction and relation between the agencies and district office of education.
Therefore, it is suggested that the revision of the laws should include the necessity of establishing the principle of dividing roles between the central government(the minister of education) and the local government(education chiefs), setting-up of the superintendent's office work to clarify the function of district office of education, and permission of the regulation based upon allowing the superintendent to manage high school-level office work as well as the enactment of an ordinance on the specific cases.
