본 연구는 정당의 선거공약이 선거 후 변경되는 ‘과정’을 분석한 사례연구
로, 대통령의 일방적 정책변경결정 이후의 국회 입법과정에서 집권당의 역할에
초점을 맞추고 있다. 집권당의 입장에서, 대통령의 공약변경 결정은 일부 혹은
다수 의원들의 이해관계와 충돌할 수 있으며, 전체로 정당이 유권자와 맺는 관
계에 부정적인 영향을 미칠 수 있음에도, 어떤 과정을 통해 대통령의 결정이
국회 안에서 관철되는지를 분석함으로써 ‘강한 대통령-약한 정당-약한 의회’라
는 한국정치의 특징이 현실에서 작동하는 메커니즘을 분석하는데 목적이 있다.
사례분석의 소재는 17대 국회 ?공정거래법?개정과정이다. 2004년 6월, 17
대 국회 개원과 함께 제출된 노무현 정부의 ?공정거래법?제1차 개정안은 집
권당의 ‘당론’으로 지지되었고 야당의 반대에도 불구하고 본회의를 통과했다.
하지만, 2006년 7월과 2007년 2월에 각각 제출된 정부의 제2차, 제3차 개정
안은, 제1차 개정안 당시 집권당의 ‘당론’과 배치된다는 평가와 집권당 의원
들의 반대에도 불구하고 원안에 가깝게 본회의를 통과할 수 있었다.
본 연구는 ① 정부제출 개정안과 집권당 및 야당의원들의 개정안 비교, ②
교섭단체 대표연설 가운데 기업지배구조 개선정책에 대한 각 정당의 입장,
③ 정무위원회-법안심사소위원회 회의록 텍스트 분석을 통해 17대 국회 ?공
정거래법?개정과정을 추적했다. 그 결과, 집권당의 동의가 없는 대통령의 일
방적인 정책변경결정이 국회 안에서 관철될 수 있었던 주요원인이, 집권당
내부의 정책 응집력과 일관성의 결여에 있음을 발견할 수 있었다. 대통령에
대해 정책적 이니셔티브를 가질 수 없는 약한 정당은 대통령의 일방적인 정
책변경을 제어하거나 숙의하게 할 수 없는 원인이 되었다.In Korea, the President tends to accomplish his purpose of policy change
in spite of dissent of his party. The object of this study is to analyse the
role of the ruling party in the legislative process after the President choose
the policy switches without consent of the party in power.
The amendment process of Fair Trade Act in the 17th Assembly shows
the mechanism of accomplishment of the President's policy change in spite
of conflict between the President and the ruling party. In the first
amendment process of Fair Trade Act in the 17th Assembly, the ruling
party agreed with the bill that the President had presented as a party
platform. After the first amendment, the President changed his mind and
presented the second and the third bill without consent of the party in
power. The second bill was regarded as the opposite policy of the first bill.
Some Members of ruling party opposed the third bill in the deliberation
process of the committee, and demanded the discussion in the ruling party.
But The President's bill passed without subscribing process of ruling party.
We analysed the party platforms of the Presidential election, the speeches
of the floor negotiation groups, the bills of Fair Trade Act in 17th Assembly, and the committee records. And we found that the policy
cohesiveness of the ruling party was very weak, and concluded that the
weak initiatives of the ruling party over the President originated from the
policy incohesiveness.
