우리 형법은 1953년에 제정된 이래 가장 큰 규모의 전면개정작업을 거치고 있다. 주지하는 대로, 제2차 세계대전의 국가비상사태 하에서 마련된 일본 “개정형법가안”의 큰 영향 아래, 한국전쟁이라는 특수상황 속에서 제정된 우리 형법은“전시형법”이라는 별명을 얻게 되었다. 물론 규정체계 안에는 지금 상황에서 보더라도 매우 선진적이라고 할 수 있는 훌륭한 규정들이 적지 않은 것이 사실이긴 하지만, 전시형법적-국가주의적 특성이 가장 짙게 배어 있는 부분이 “내란-외환의 죄”를 중심으로 한 국가적 법익에 대한 죄의 규정들이다. 이 부분의 규정들이 오늘날 오랜 기간의 휴전을 거치면서 전쟁을 잊어가는 준평화시대를 맞아 과연 계속 유지될 수 있는가 하는 규범적 고찰이 필요한 시점에 이르렀다고 할 수 있다. 특히 “외환의 죄”는 국제정치 측면에서 탈냉전-탈이념의 시대에 내외적으로 규범으로서의 타당성이나 실효성이 위협을 받고 있는 만큼, 이 점은 심각하게 검토될 필요성을 안고 있다. 본고에서는 우리 형법상 “외환의 죄”의 각 규정들을 관련 외국의 법제와 비교하여 입법론적 측면에서 검토하고 있다. 논문의 본론에서는 “외환의 죄”의 각 부분을 범죄유형에 따라 ‘외환유치죄-여적죄’, ‘이적죄-군수계약불이행죄’, ‘간첩죄’의 세 분야로 나누어 검토하고 있다. 하지만, 무릇 입법론이라는 연구분야가 대부분 그렇듯이, 단순히 선진 각국의 법제와의 비교를 통하여 우리 법제의 장-단점을 추출한다는 것은 사회규범으로서의 우리 법의 가치에 대한 올바른 평가가 되기 어렵다. 물론 우리 형법이 “전시형법”으로서의 태생적 특성을 안고 있기는 하지만, 어느덧 60년에 가까운 세월 동안 우리 국민의 법의식이나 법감정에 깊게 뿌리를 내리고 있으며 또 우리 사회가 아직은 완전한 서구적 평화시대를 구가할 수 있는 형편이 아닌 것이 현실인 만큼 외국의 법제와의 단순한 비교연구를 통한 평가는 신중하여야 할 점이다. 법규범은 이론적-철학적 타당성과 함께 수범자인 국민과 해당 국가시회의 현실상황이 조화를 이룰 때에 비로소 규범으로서의 역할을 제대로 수행할 수 있는 것이기 때문이다. “외환의 죄”의 범죄유형들 중 오늘날 우리 사회가 당면하고 있는 시대적-사회적-국제정치적 측면에서의 다양한 난관이 가장 극명하게 드러나는 부분이 ‘간첩죄’이다. 최근에 크게 사회적 관심과 우려를 불러일으키고 있는 전-현직 공직자들과 국방관련 중요산업체의 임직원들의 무분별-무차별적인 국가-군사기밀유출사고를 보면서, 우 형법의 규정체계에는 그 동안 겪지 못했던 새로운 위기상황에 대한 대비가 커다란 허점으로 방치되어 왔다는 사실을 깨닫게 되었다. “전시형법”으로서 지나친 엄격형법으로 군림해온 것으로만 인식되어 왔던 우리 형법이 오히려 외국의 입법에 비하여 크게 허술한 무능형법으로 제 기능을 올바로 수행하지 못하고 있었던 것이다. 이런 문제는 정치-사회지도층의 도덕적 해이와 맞물려 공직부패의 엄청난 암수범죄, 그리고 장기간에 걸친 남북의 피곤한 대치와 간단없는 군사적 충돌로 인한 불안감 등 우리 사회의 어려운 실상이 드러난 한 부분이라고 볼 수 있다. 본고는 이런 상황 속에서 우리 형법, 그 중에서도 “외환의죄” 부분이 규범으로서의 제 기능을 실효적으로 수행할 수 있도록 하기 위한 작업의 일환이다.Inducement of Foreign Aggression(Article 92 of Korean Criminal Act), Taking Side with Enemy(Article 93), Benefiting Enemy by Levying Soldiers(Article 94), Benefiting Enemy by Providing Equipment(Article 95), Benefiting Enemy by Destroying Equipment(Article 96), Benefiting Enemy by Delivering Goods(Article 97), Spy(Article 98), Non-Performance of Munition Contract in Wartime(Article 103) are punished in Korea. The current Korean Criminal Act was enacted during the Korean War in 1953. The regulation of crimes concerning foreign aggression was originated from a draft of the revision of the Japanese Criminal Act in 1940 so that both regulations had almost same legal elements and legal punishment. The draft of the revision of the Japanese Criminal Act was enacted under influence of the German Nazi Criminal Act to have characteristics of militarism as well as totalitarianism and to punish a threat against the government system strictly. Since enactment of the Criminal Act, as many as 50 years has elapsed to make great change of politics as well as economy. These days, the world has become free from ideological confrontation to let each country maximize its own profits and benefits, and external threat against countries has overcome level of ‘armed provocation’ triggered by ‘enemy country’ to be either ‘threat not by enemy country but by foreign countries’ or ‘outflow of national wealth’ from point of view of actual profit. In particular, a variety of legal and systematic tools for national safety under special situation of confrontation between both Koreas were made to conflict with the crimes concerning foreign aggression of the Criminal Act. At the moment, the concept of national security and espionage is needed to make change and to be flexible enough to meet the realities. With the problem awareness, the study critically investigated requirements of the espionage that was important area of foreign exchange related crimes of the Criminal Act from point of view of comparison law to interpret and apply laws harmoniously between national security related law systems such as the National Security Act and the Criminal Act and to suggest legislative alternatives that could help national security. In particular, to reform existing law, the study introduced not only 1992 draft of the revision of the Criminal Act suggested by Special Committee of the Revision of the Criminal Act organized in 1987 but also 2009 draft of joint revision of both the Korean Criminal Law Association and the Korean Association of Criminology and considered the drafts as much as possible from point of view of legislation.
