휘튼(Henry Wheaton)의 저서 『Elements of International Law』는 19세기 중반 구미사회에서 널리 사용되던 국제법 개설서였다. 이 책은 선교사 마틴(W. A. P. Martin)에 의해 『萬國公法』이란 제목으로 번역되어 중국에 소개되었는데, 중국인에게 근대 국제법을 체계적으로 소개한 최초의 번역서였다. 여기서 ‘만국공법’은 좁은 의미에서 책이름이기도 하고, 넓은 의미에서 국제법의 또 다른 명칭이기도 하다. 본 논문에서는 번역서 『만국공법』에 나타난 해양관련 국제법을 정리 분석할 것이다. 왜냐하면 『만국공법』의 내용 가운데 해양관련 법 규정이 방대함에도 불구하고 해양의 관점에서 이 책을 주목한 연구가 거의 없기 때문이다.
마틴이 번역한 『만국공법』에는 해양관련 내용이 풍부하다. 『만국공법』은 실제로 영해와 공해에 대한 개념 규정에서 시작해 해도를 금지하고 해상의 범죄를 징벌하는 내용, 해상에서 나포하는 규칙, 군함을 만들고 해군을 육성하는 것 등 해양 관련 내용이 무척 많다. 당시 해양관련 주요 법률들을 충실히 담고 있어서 해양국제법 서적이라고 해도 무리가 없을 정도이다. 해적이나 민간선박의 포획면허장과 같은 내용은 근대 서양의 특징을 잘 보여주며, 선점과 정복 관련 항목은 제국주의적 특색을 적나라하게 보여준다. 특히 영해나 공해와 같은 인식이나 해양에서의 전쟁에 관한 섬세한 묘사는 중국인들에게 해권과 관련해 신선한 충격을 주었다.This paper is about the arrangement and analysis of the international law related to the ocean appeared in 『Elements of International Law』. Even though there are many rules in marine laws related to the ocean among the contents of 『Elements of International Law』, nowdays there are few intensive researches paying attention to this book in the point of view of the ocean. In reality, the contents of the chapter 4 of this Book 2, the chapter 2 and 3 of this Book 4 are rules of the marine laws related to the ocean, and there are many marine laws except those chapters. In these chapters, we can read almost all the rules about the modern ocean. Those are a judgement referred to the pirate as well as the article about territorial waters, the courtesy in the navigation, the right controlling the belt along the coast, the right of fishing, the problem of common property of ocean, and the article about a naval battle. As this book contains several main rules related to the ocean, it is not unreasonable to call this book itself as an international maritime law. Thus『Elements of International Law』shows us clearly how the modern western nations seizure and control the ocean, and then the Chinese version of this book played an important role to have a new recognition and awakening about the ocean to Chinese people.
This presentation is divided into two parts: at the wartime and normal time. Each time is arranged with the rules of the maritime law about the ocean respectively.
