『지적재조사에 관한 특별법』이 국회 본회의를 통과하고(2011. 8. 23), 법률 제11062호로 공포됨으로써(2011. 9. 16) 일제 강점기에 만들어진 오래된 아날로그 지적이 우리의 독자적인 기술을 활용하여 디지털 지적으로 전환할 수 있는 계기가 마련되었다. 이는 지적업무에 대한 단순한 등록 및 관리 차원을 넘어서 토지에 관련된 모든 것을 종합적으로 관장하여야 하는 새로운 조직의 구성에 대한 타당성을 부여받은 것을 의미한다. 따라서 이에 적합한 실행 조직 및 인력의 확보와 미래지향적인 종합적인 공간정보를 제공할 수 있는 토지 관리와 운영을 위한 시스템에 대한 연구가 필요한 시점이다. 이 연구는 구체적인 사무 범위에 대한 논고에 초점을 두기보다는 지적업무를 담당하는 중앙 행정조직과 지방 행정조직 간의 역할분담과 조직의 형태를 구상하는 거시적 관점에서 조명되었으며, 토지에 관련된 모든 업무를 종합적으로 추진하고 있는 독일의 조직 모델을 분석함으로써 우리나라가 지적 선진화와 함께 이루어야 할 차세대 지적 행정조직의 모형 개발을 위한 시사점을 도출하고자 하였으며, 결과적으로 시·도 직속에 “지적관리청(가칭)”을 신설하여 지방자치단체 장으로부터의 토지 등록이나 관리업무를 완전 독립시키는 모델을 제안하고 있다.Analogue cadastre in South Korea developed in Japanese colonial age has a chance to move to digital cadastre using our own technique as the 『Cadastral Resurvey Special Law』(Law No. 11062) has been in effective from Sep. 16, 2011, which was passed by S. Korea’s mational assembly general meeting on Aug. 23, 2011. It means that the construction validity of new organization to manage overall land-related affairs beyond the current simple land registration and management on cadastral affairs is granted. Accordingly, it is the right time to be requiring a research of the system for land management and operation assisting appropriate executive organization and man power and offering integrated spatial information. The study is reflected from a macro-scopic point of view on cadastral affairs not specific affair scope but affair allotment and organization pattern between central administrative organization and local administrative organization. The study has a purpose to extract some solutions for the model development of cadastral administration in S. Korea which should be accomplished with the project of cadastre advance by analyzing the German cadastral organization models generally managing whole land-related affairs. As a result, the study suggests the independence of land registration and management operation from a local province governor by setting up a new model, “Cadastral Agency” tentatively named.
