본 연구에서는 미디어 콘텐츠가 하나의 저작물로서 보호를 받을 수 있는 법적 근거를 제시하려는 목적에서, 저작물 성립 요건으로서의 창작성 개념과 판단 기준에 대한 국내 법원의 판결 논리를 분석했다. 판례 분석 결과, 창작성 개념의 핵심 구성 요소는 독자성과 개성인 것으로 나타났다. 독자성은 저작물이 저작자에게서 유래되고, 모방하지 않고 다른 저작물과 구분되는 속성으로, 개성은 정신적 노력의 소산, 지적 노력, 개성적·정신적 창작의 성과 등으로 설명되었다. 또한 법원은 저작물의 창작성 수준을 뛰어난 예술성이나 창의성을 요구하는 정도로 높게 책정하지 않고 최소한도의 수준이면 충분하다고 보고 있어, 저작권에서의 창작성 개념을 광범위하게 해석했다. 저작권법의 보호 여부를 결정짓는 창작성 판단 기준은 저작물 유형이나 속성에 따라 조금씩 차이를 보였다. 문예적 저작물은 표현의 창조적 개성 기준이 공통적으로 적용되지만, 사진 저작물은 기술을 이용한 피사체의 재현이라는 저작물의 특성상 창작성 판단 기준이 좀 더 엄격하게 적용되는 특징을 보였다. 표현 방식이 제한되는 특성이 있는 기능적 저작물은 아이디어와 표현의 이분법 그리고 합체의 원칙 등을 적용해 창작성 기준을 일정한 수준 이상으로 엄격하게 적용하는 판결 성향을 나타냈다. 또한 편집 저작물은 소재의 선택과 배열에 일정한 기준이나 방침, 목적이 있는지 여부가 창작성을 판단하는 데 중요하게 작용했으며, 2차적 저작물은 독자적인 표현의 부가와 고도의 창작적 노력을 요구함으로써 창작성의 기준을 상대적으로 높게 책정했다.This study analyzes the concept and the standard of creativity as a requirement for copyrightable works in the cases of Supreme Court of Korea where creativity is an issue, in order to suggest the legal guidance by which media contents can be protected of copyright. This case study demonstrates that the key factors constituting the concept of creativity are independent creation and personal characteristics. The former means that the work owes its origin to the author, is not copied from another similar work, and is differentiated from the other works. The latter means the fruits of intellectual effort and characteristic creation. Courts require works to contain at least a “modicum of creativity” in order to receive copyright protection, not the high level of creativity which is required in literary or artistic works. They suggest that the concept of creativity in copyright is used wider than that of literary and arts. The result also shows that the standard of creativity varies depending on the type and attribute of works. The creative expression standard is generally applied to literary works, but there is a tendency that the stricter standard is applied in the case of photographic works which is representation of object by technology.
The stricter standard is applied to the functional works of which expression method is restricted by the rule of idea/expression dichotomy and the Merger Doctrine.
Courts view it as an important standard in recognizing creativity of factual compilations whether there is a certain standard, rule or purpose in selection and arrangement of preexisting materials. Furthermore, they apply the much stricter standard to derivative works by requiring additional independent expression and high level of creative efforts.
